Background:
Kairos Power LLC (Kairos) began pre-application discussions with the U.S. Nuclear Regulatory Commission (NRC) staff on its proposed Kairos Power Fluoride-Salt-Cooled, High-Temperature Reactor (KP-FHR) in October 2018. By letter dated September 29, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21272A375), Kairos submitted the Hermes test reactor construction permit (CP) application including the Preliminary Safety Analysis Report (PSAR). On December 14, 2023, the NRC staff issued a CP to Kairos for the Hermes test reactor (ML23338A260). As discussed in a public meeting held on February 20, 2024 (ML24061A113), Kairos plans to submit a topical report (TR) on their safety analysis methodology in support of a future application for an operating license (OL) for the Hermes test reactor in accordance with Title 10 of the Code of Federal Regulations (10 CFR)
Part 50, Domestic Licensing of Production and Utilization Facilities. The Hermes PSAR followed the guidance in NUREG-1537, Part 1, Guidelines for Preparing and Reviewing Applications for the Licensing of Non-Power Reactors, Format and Content (ML042430055) and it is expected that the Hermes final safety analysis report will similarly align with NUREG-1537.
Purpose:
This audit will provide the NRC staff an opportunity to assess the readiness of the draft TR before it is formally submitted for the NRC staffs review. The audit will allow the NRC staff to (1) identify any required information that is missing from the TR, (2) identify technical or regulatory issues that may complicate the acceptance or technical review of the TR, (3) become familiar with the content of the TR, particularly in areas where Kairos plans to propose new concepts, and (4) become familiar with the separate and integral effects tests facilities supporting the safety analysis methodology.
Regulatory Audit Basis:
The bases for the audit are the regulations in 10 CFR pertinent to the NRC staffs review of a future Hermes OL application, particularly 10 CFR Part 50, Sections 50.34, Contents of
2 applications; technical information, 50.40, Common standards, and 50.57, Issuance of operating license.
Regulatory Audit Scope The NRC staff will use parts of NRCs Office of Nuclear Reactor Regulation (NRR) Office Instruction LIC-116, Pre-application Readiness Assessment (ML20104B698), to inform the scope of this audit. This audit will cover all the chapters of the draft TR.
Information and Other Material Necessary for the Regulatory Audit The NRC staff requests that all the documents in the audit scope be provided by Kairos on an online reference portal. An online reference portal, established by Kairos, would allow the NRC staff access to technical information. Use of the online reference portal is acceptable provided that Kairos establishes measures to limit access to specific NRC staff (e.g., based on NRC e-mail addresses or the use of passwords which will only be assigned to the NRC staff directly involved in the audit on a need-to-know basis) and to make the documents view-only (i.e.,
prevent NRC staff from saving, copying, downloading, or printing any documents). The conditions associated with the online reference portal must be maintained throughout the audit process. The NRC staff who should initially be granted access to the portal are listed in the Team Assignments section below. The NRC audit project managers will provide Kairos with the names of additional NRC staff who should be granted access.

Logistics Entrance Meeting April 1, 2024 Exit Meeting April 19, 2024, estimated and subject to change The audit will follow the guidance in the Office of NRR, Office Instruction LIC-111, Regulatory Audits (ML19226A274). Audit meetings will take place primarily in a virtual format, using Microsoft Teams, or via other, similar platform. Audit meetings will be scheduled on an as needed basis after the entrance meeting and once the NRC staff has had the opportunity to review any documents placed in the online reference portal.
3 The NRC staff will also visit Kairos Power Headquarters in Alameda, CA during the audit to enable in-person discussions and to view Kairos Power separate effects and integral effects test facilities that are expected to provide experimental data for the validation of the safety analysis methodology.
The audit duration is anticipated to be approximately 3 weeks with activities occurring intermittently during that period. The NRC staff estimates that the level of effort for the audit is approximately 250 hours0.00289 days <br />0.0694 hours <br />4.133598e-4 weeks <br />9.5125e-5 months <br />.
Special Requests The NRC staff requests that Kairos Power ensure that their technical staff are available to answer questions during the audit.
Deliverables At the completion of the audit, the audit team will issue an audit summary within 90 days after the exit meeting but will strive for a shorter duration. The audit summary will be declared and entered as an official agency record in ADAMS and be made available for public viewing through the publicly available records component of ADAMS.
