SUBJECT:

SUMMARY

OF FEBRUARY 22, 2024, MEETING WITH THE NATIONAL ORGANIZATION OF TEST, RESEARCH, AND TRAINING REACTORS On February 22, 2024, an observation public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of the National Organization of Test, Research, and Training Reactors (TRTR). The purpose of this meeting was to discuss rulemaking, licensing, oversight, and upcoming meetings related to the TRTR community. The meeting notice and agenda, dated February 15, 2024, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML24046A211. A list of meeting attendees is enclosed. The following is a description of the meeting topics.

The NRC staff provided an overview of required reporting to the Nuclear Materials Management and Safeguards System (NMMSS), highlighted resources and helpful NUREG guidance, shared opportunities for training and informed attendees of the Annual NMMSS Users Training Meeting scheduled for May 13-16, 2024, in Las Vegas, Nevada. Emphasis was placed on the material control and accounting (MC&A) program and site-level domestic safeguards training. NRC staff discussed strategies and programs for retention and personnel development in this niche nuclear discipline, and connections were drawn between the importance and value in site-level MC&A and safeguards to the larger global goal of nonproliferation. The presentation is included in this meeting summary as attachment 1.

The NRC staff presented on the Dodd-Frank Act Rulemaking, which is proposed to remove bond rating criteria for use of guarantee mechanisms currently cited in Appendices A, C, and E of Title 10 of the Code of Federal Regulations (10 CFR) Part 30. The rule would replace the bond rating criteria with a new creditworthiness criteria standard. The NRC would access creditworthiness and make determinations based on the information submitted by applicants or licensees. Licensees using Self or Parent Company guarantees will have one year from the date that the rule is finalized to conform to the new regulation. The presentation is included in this meeting summary as attachment 2.

The NRC staff discussed its response to the Office of the Inspector Generals Special Inquiry into the NRC's Oversight of Research and Test Reactors (RTRs) and provided an update on the Non-power Production or Utilization Facility (NPUF) License Renewal Rule, in addition to a status of the revision of NUREG-1537, Guidelines for Preparing and Reviewing Applications for the Licensing of Non-Power Reactors. The rule is with the Commission and NUREG-1537 is currently in revision. NRC staff intends to provide a draft for public comment. An update was presented on the 10 CFR 50.59 regarding digital modification guidance.

March 15, 2024 The NRC staff discussed the progress of the revision of NUREG-1478, Operator Licensing Examiner Standards for Research and Test Reactors, Revision 3. The NRC staff informed the TRTR that the draft revision of the NUREG-1478 is anticipated to be published for public comment in the spring 2024. The NRC staff encouraged the TRTR community to ensure their oversight committees are effective and provide independent feedback to their operations. The NRC plans to update inspection guidance for the review of facility oversight committee audits.

The TRTR community led a discussion on their initiative on Sub-committee on Reactor Operator (RO) / Senior RO examinations in which certain facilities would conduct examinations, similar to the power reactors examination processes.

The NRC staff reminded the TRTR community about the workshop on February 28, 2024, 1-4 p.m., on training for NRC Form 396, "CERTIFICATION OF MEDICAL EXAMINATION BY FACILITY LICENSEE," and NRC Form 398, "PERSONAL QUALIFICATION STATEMENT --

LICENSEE". The TRTR community emphasized the reasons why the community values the NRC staffs attendance at the TRTR Annual Conference, scheduled to be held in Albuquerque, NM, on September 30 - October 3, 2024.
