OF THE FEBRUARY 13, 2024, PUBLIC MEETING TO DISCUSS POSSIBLE EFFICIENCIES ON THE SUBSEQUENT LICENSE RENEWAL REVIEW On February 13, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff held an information meeting with the Nuclear Energy Institute (NEI) on possible efficiencies on the Subsequent License Renewal (SLR) review. The public meeting notice is located at Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML24044A040. The agenda and list of meeting attendees are enclosed in Enclosures 1 and 2 of this meeting summary, respectively.

SUMMARY

As follow-up meeting from the January 11, 2024, meeting (ML24024A227), the purpose of this meeting was for the NRC staff to further discuss efficiency opportunities for the SLR review process with NEI, industry, and members of the public. Both the NRC staff (ML24039A097) and NEI (ML24044A010) made presentations that contributed to fruitful dialogue.

To kick off the NRC staffs presentation, the staff stated that the overall objective for license renewal is to maintain timely, predictable, and efficient reviews, with a focus on safety. To meet its objective, the staff is developing the Tiered Approach.

The Tiered Approach aims to achieve the direction of the NRC Commission in Staff Requirements Memorandum (SRM) M231102, Staff Requirements - Strategic Programmatic Overview of the Operating Reactors and New Reactors Business Line, issued December 11, 2023 (ML23345A214). by incorporating risk insights, leveraging operating programs, leveraging previous reviews, leveraging the NRC and industrys operating experience with aging management, and considering consistency with NRC guidance documents.

The NRC staff described its plans to conceptualize, formalize, and document the Tiered Approach framework, while offering insights on how external stakeholders can provide input.

Following the NRC staffs presentation, NEI requested additional detail on the Tiers of Review and how binning of technical areas will be conducted. The NRC staff explained that the draft Tiered Approach currently highlights a total of 3 tiers of review: standard (high), modified (medium), and confirmation (low). The staff will make a generic determination to bin each technical area to a tier. Then, the levels may be adjusted on a plant-specific basis upon receipt of the application.

NEIs presentation focused on the Graded Approach, one that makes risk and safety significance the driver for depth of review, maximizes credit for adherence to guidance and standardization, focuses on what has changed since the initial license renewal, leverages fleetwide programs, considers licensee commitments that continue from initial license renewal to subsequent license renewal, and finally, takes into account routinely inspected programs subject to other regulatory requirements.

The focus of the presentation was on the last concept (i.e., taking into consideration routinely inspected programs subject to other regulatory requirements). NEI offered their insights on how the NRC staff could leverage oversight and inspections conducted on some of the technical areas of the license renewal application.

Following NEIs presentation, the NRC staff expressed appreciation for the detailed presentation. The staff noted that NEIs presentation resembles very closely to the kind of discussions the staff are having internally to determine applicable operating programs to take into consideration as part of the Tiered Approach.

Afterwards, additional dialogue was exchanged, including, support and interest from the industry to leverage operating programs, considerations for consistency with NRC guidance documents, leveraging recent lessons learned from Title 10 of the Code of Federal Regulations Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants, and monitoring of staff hours.

NEI inquired whether any discussion would be held on the efficiencies regarding the environmental review. In response, the NRC staff encouraged attendees to participate in the NRCs upcoming Regulatory Information Conference in March 2024 to learn more about the staffs efforts on efficiencies for environmental reviews.

At the end of the meeting, the NRC staff reiterated its plans to continue finalizing the Tiered Approach for implementation from March to April 2024. While there are significant efforts to improve the efficiency of SLR, the NRC staff noted that NRC resources and schedules would be optimized if the industry staggers their submittals to one application every 3 months. Staggering submittals was leveraged informally for initial license renewals but has not yet been implemented for SLRs.
