OF THE DECEMBER 14, 2023, PUBLIC MEETING WITH THE NUCLEAR ENERGY INSTITUTE TO DISCUSS LIMITATIONS AND CONDITIONS ASSOCIATED WITH NEI 16-03, REVISION 1, GUIDANCE FOR MONITORING OF FIXED NEUTRON ABSORBERS IN SPENT FUEL POOLS (EPID L-2022-NTR-0002)

On December 14, 2023, the U.S. Nuclear Regulatory Commission (NRC) conducted a public meeting with the Nuclear Energy Institute (NEI), Electric Power Research Institute (EPRI), and industry representatives to discuss the Limitations and Conditions section of the NRCs draft safety evaluation (SE) for Topical Report (TR) NEI 16-03, Revision 1, Guidance for Monitoring of Fixed Neutron Absorbers in Spent Fuel Pools. The TR was transmitted to the NRC on August 19, 2022, and supplemented by letter dated October 12, 2022, and are available in NRCs Agencywide Documents Access and Management System (ADAMS) under Accession Nos. ML22231B041 and ML22298A281, respectively. The public meeting was conducted in a hybrid meeting format via Microsoft Teams where meeting attendees participated virtually, in-person, and by telephone. The meeting notice and agenda dated November 30, 2023, are available in ADAMS under Accession No. ML23348A083. The industry presentation slides are also available in ADAMS under Accession No. ML23347A178. A list of meeting attendees and participants is enclosed to this summary.

The main objective of the meeting was to provide clarity on the context of the Limitations and Conditions section described in the draft SE (ADAMS Accession No. ML23291A013). At the beginning of the meeting, NEI representatives shared their perspective on how the limitations in the draft SE could affect the scope and implementation of the program. NEI representatives also stated that they want to bridge the gap between NRC licensees with spent fuel pools who currently have a BORAL coupon surveillance program to those who do not.

The NRC staff conveyed that licensees are always allowed to choose their own surveillance method, and from NRCs perspective, after completion of NRCs review and approval of this TR, the i-LAMP program could provide one of these options. The NRC staff stated that licensees with spent fuel pools, no matter whether they have coupons or not, must verify if the conditions that cause degradation apply to them. The NRC staff also mentioned that licensees must show if they are bounded by a plant and the only way for them to determine if it bounded is to find a sibling plant.

At the conclusion of the meeting, the NRC staff stated that the draft SE is currently in the comment-resolution phase of the review and informed the NEI representatives that they have the opportunity to comment on the proposed language for NRC review. In response, NEI representatives confirmed that they plan to send comments on the draft SE for NRC review and disposition within the next two weeks.

During the public comment period, Jana Bergman of Curtiss-Wright, asked if the meeting slides and draft SE would be available in ADAMS and made publicly available. The NRC staff confirmed that the documents had been added to ADAMS and are publicly available.

No regulatory decisions or commitments were made at this meeting.
