SUMMARY
OF NOVEMBER 2, 2023, U.S. NUCLEAR REGULATORY COMMISSION PUBLIC MEETING WITH THE PRESSURIZED WATER REACTOR OWNERS GROUP TO DISCUSS ITEMS RELATED TO STANDARD TECHNICAL SPECIFICATION 3.5.3 On November 2, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held a public observation meeting with representatives from the Pressurized Water Reactor Owners Group (PWROG) on items related to Standard Technical Specification 3.5.3 ECCS [Emergency Core Cooling System] - Shutdown (TS 3.5.3). The meeting was held in a hybrid format (i.e., meeting attendees participated in person, via computer, and by teleconference). The meeting provided the opportunity for NRC staff to have an open dialogue with industry representatives in an open and collaborative setting. The meeting notice and presentation slides are publicly available in the NRCs Agencywide Documents Access and Management System (ADAMS) under Accession Package No. ML23355A000. A list of the meeting attendees is enclosed.
The purpose of the meeting was to discuss TS 3.5.3 and its applicability to the criteria in Title 10 to the Code of Federal Regulation (10 CFR) 50.36 (c)(2)(ii). PWROG requested NRC feedback regarding its concept that TS 3.5.3 does not satisfy the criteria of 10 CFR 50.36(c)(2)(ii) and could possibly be relocated out of the TS to a licensee-controlled document.
During the meeting, PWROG representatives explained the history and timeline of Shutdown Risk and Operations Program related to loss-of-coolant accident in Shutdown Modes 3 and 4.
PWROG representatives stated that when issues arise as a result of NRC inspection oversight process during shutdown operations they are addressed through the means provided in the oversight process.

At the end of the presentation, PWROG representatives mentioned that there is no regulation requiring the analysis of a design-basis accident for loss of coolant in Mode 4. Licensees currently address Mode 4 loss of inventory and decay heat removal events with voluntary programs by the implementation of a shutdown risk and operation program that meets the applicable requirements in 10 CFR 50.65(a)(4). PWROG representatives stated that since one operable ECCS train in Mode 4 does not satisfy any of the criteria of 10 CFR 50.36(c)(2)(ii), it should not be included in the TSs. The NRC staff shared feedback on risk insights and staff evaluations relevant to the topic discussed. PWROG communicated that it plans to submit an NRC traveler for NRC staff review in the near future to address the topics discussed at the meeting.
At the conclusion of the meeting, there was an opportunity for the public to provide comments and ask questions. It was noted that no public comments were received.
