NRC STAFF REVISED EXHIBIT LIST The U.S. Nuclear Regulatory Commission staff (Staff) hereby files its revised exhibit list for the mandatory hearing on the Kairos Power LLC Construction Permit application. The exhibit list is being updated to reflect a revision to NRC-009, Staff Presentation Slides -

Overview Panel, which is now designated NRC-009-R.

The revision to NRC-009 corrects an error regarding the absence of an arrow connecting the Final NEPA Document box and the Mandatory Hearing box on the flowchart depicted on Slide 18. Slide 18 now reflects the connecting arrow. The inadvertent omission of the connecting arrow was not intended to convey a Staff position that its environmental review is an unnecessary input to the mandatory hearing.

The Commission has acknowledged that NRC requirements for mandatory hearings stem from both the Atomic Energy Act and the National Environmental Policy Act (NEPA). 1 The Commission has also stated its expectation that presiding officers for uncontested hearings determine baseline NEPA questions, i.e., whether the NEPA process has been complied 1 Exelon Generation Co. with, what is the appropriate final balance among conflicting factors, and whether the construction permit should be issued, denied or appropriately conditioned. 2 Consistent with previous Commission statements, and with 10 C.F.R. § 51.105(a)(4), the Hearing Notice for the Kairos mandatory hearing stated that the Commission would consider in an uncontested proceeding whether the NEPA review conducted by the NRC staff had been adequate. 3 The Staff regrets the confusion associated with Slide 18.

Staff counsel informed Kaiross counsel of the revision described above. Kaiross counsel advised that it has no objection to the revised exhibit list and the admission of Exhibit NRC-009-R into the record.
