UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION BEFORE THE COMMISSION In the Matter of KAIROS POWER LLC (Hermes Test Reactor)
Docket No. 50-7513-CP NRC STAFF REVISED EXHIBIT LIST The U.S. Nuclear Regulatory Commission staff (Staff) hereby files its revised exhibit list for the mandatory hearing on the Kairos Power LLC Construction Permit application. The exhibit list is being updated to reflect revisions to NRC-002, Draft Construction Permit for Kairos Power LLC, which is now designated NRC-002-R, and NRC-003, Draft Summary Record of Decision for Kairos Hermes Test Reactor Construction Permit, which is now designated NRC-003-R. The revisions to NRC-002 and NRC-003 document completion of the Section 106 consultation process under the National Historic Preservation Act (NHPA) for this licensing action.
The draft Construction Permit, NRC-002, is modified as follows:
In paragraph 1.E, the title of Part 100, Reactor Site Criteria, is added.
In paragraph 1.F, the title of Part 20, Standards for Protection Against Radiation, is added.
In paragraph 1.J, the title of Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions, is added.
In paragraph 2, the title of Part 50, Domestic Licensing of Production and Utilization Facilities, is added.
In paragraph 3, the title of 10 CFR 50.55, Conditions of construction permits, early site permits, combined licenses, and manufacturing licenses, is added.
In paragraph 3.D, the title of 10 CFR 50.4, Written communications, is added.
2 In Section 2.0 of Appendix A, U.S. Nuclear Regulatory Commission (NRC) is added to the paragraph.
In Section 2.1 of Appendix A, U.S. Nuclear Regulatory Commission and the parentheses around NRC are removed.
In Section 2.4 of Appendix A, the placeholder language is removed and the following text is added:
In accordance with Section 106 of the National Historic Preservation Act, Kairos shall implement its Archaeological Resource Monitoring and Unanticipated Discovery Plan.
The draft Record of Decision, NRC-003, is modified to remove placeholder language throughout and to remove the heading Cultural Resources from page 9. Additional text is added to the following sections:
Consultations under NHPA Section 106, on page 7 Mitigation Measures, on page 8 Historic and Cultural Properties, on page 9 The additional text in these sections describes the NHPA Section 106 consultation process for this proceeding and documents consultation closure.
Staff counsel informed Kaiross counsel of the revisions described above. Kaiross counsel advised that it has no objection to the revised exhibit list and the admission of Exhibits NRC-002-R and NRC-003-R to the record.
