UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION BEFORE THE COMMISSION In the Matter of KAIROS POWER LLC Docket No. 50-7513-CP (Hermes Test Reactor)
NRC STAFF EXHIBIT LIST AND NOTICE OF REVISIONS The U.S. Nuclear Regulatory Commission (NRC) staff (Staff) hereby files its exhibit list for the mandatory hearing on the construction permit application for Kairos Power LLC (Kairos).
Each exhibit has been listed and marked according to the instructions in the Commissions Scheduling Order, dated October 5, 2023.
The sections below describe changes to the draft Construction Permit (CP) and draft Record of Decision (ROD). The draft CP and draft ROD have previously been made publicly available in the Agencywide Documents Access and Management System (ADAMS).
A. Change to Draft CP as Identified in Response to Commission Question As indicated in its response to the Commissions Pre-hearing Question 21, the Staff no longer proposes to include a provision in the CP requiring Kairos to request a license amendment to incorporate Terms and Conditions set forth in the Incidental Take Statement of Biological Opinions issued subsequent to the effective date of the Environmental Protection Plan (EPP).
- In Appendix A to the draft CP, the following text in Section 4.4 Changes in Environmental Protection Plan, is deleted:
o The permit holder shall request a license amendment to incorporate the requirements of any Terms and Conditions set forth in the Incidental Take
Statement of Biological Opinions issued subsequent to the effective date of this EPP.
The change described above is reflected in the exhibit marked NRC-002.
B. Change to Draft ROD as Identified in Response to Commission Question As stated in its response to the Commissions Pre-hearing Question 22, prior to issuing the final environmental impact statement (FEIS), the Staff reviewed the Fiscal Responsibility Act (FRA) and the amendments to NEPA and found that the FEIS was consistent with the requirements of the FRA. The staff made the following change to the draft ROD consistent with its response to Question 22.
- The footnote at the bottom of page 4 in the draft ROD has been revised to read:
o NEPA was amended in June 2023 by the Fiscal Responsibility Act of 2023 (FRA).
The Staff determined that the FEIS is consistent with the requirements of the FRA.
The change described above is reflected in the exhibit marked NRC-003.
