RESPONSE TO LETTER PEC REQUEST RESCISSION AND REQUEST FOR RESPONSE EXTENSION

Dear Mr. Padgett:

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your letter PEC Request Rescission and Request for Response Extension dated January 19, 2023, (Agencywide Documents Access and Management System [ADAMS] Accession Number ML23019A349),

requesting to provide a written response instead of holding a pre-decisional enforcement conference (PEC) for the two apparent violations documented in NRC Inspection Report 07003103/2022007, dated December 8, 2022 (ADAMS Accession No. ML22341A606).

Your letter also requested an extension to respond to the apparent violations by February 14, 2023, superseding the request in your letter dated January 17, 2023 (ADAMS Accession No. ML23017A153) for an additional extension of the PEC beyond the 30-day extension that the NRC had in our letter dated December 29, 2022 (ADAMS Accession No. ML22355A465).

Based on the review, the NRC staff concludes that a written response instead of a PEC is acceptable and approves your request to provide that written response by February 14, 2023.

This letter, its enclosure, and your response (if any) will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with Title 10 of the Code of Federal Regulations 2.390, Public Inspections, Exemptions, Requests for Withholding.
