ACKNOWLEDGMENT OF RECEIPT OF THE NUSCALE US460 STANDARD DESIGN APPROVAL APPLICATION (05200050)

Dear Ms. Fosaaen:

On January 1, 2023, NuScale Power, LLC (NuScale) submitted its complete standard design approval (SDA) application for a Small Modular Reactor to the U.S. Nuclear Regulatory Commission (NRC), pursuant to the requirements of Title 10 of the Code of Federal Regulations, Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants. This SDA application package was preceded by a transmittal letter dated November 21, 2022, which indicated the application would be submitted in a staged approach by December 31, 2022. This letter can be found in the NRC Agencywide Documents Access and Management System (ADAMS) Accession No. ML22325A349. By January 8, 2023, NuScale submitted all needed contents of the SDA application, including supporting technical and topical reports; and provided updated files that allowed successful completion of NRCs electronic processing of the SDA application package.

The NRC staff acknowledges receipt of your application package following a successful NRC electronic document processing and loading into ADAMS on January 8, 2023.

The NRC staff began its acceptance review on Monday, January 9, 2023. The NRC staff plans to make its determination on acceptability for docketing by March 10, 2023. The staff will communicate with you if issues arise during the acceptance review. The NRC staff will also complete a sensitive unclassified non-safeguards information (SUNSI) review followed by a notice that will be forwarded to the Office of the Federal Register to inform the public of the receipt and availability of the subject application.

Also, please note, as communicated to you in the staffs letter dated May 11, 2022 (ADAMS Accession No. ML22124A209), acceptance and docketing of the SDA application is contingent on the acceptability for review of the Topical Reports submitted to support the application.

If your application is found to be acceptable, the NRC staff will publish a schedule for review of the US460 SDA application.
