OF PRE-SUBMITTAL ENVIRONMENTAL REVIEW MEETING (DOCKET NUMBER: 50-440)

Dear Rod Penfield:

By letter dated May 13, 2020, (Agencywide Documents Access and Management System

[ADAMS] Accession Number ML20134H987) Energy Harbor (the applicant), submitted a letter of intent to submit a license renewal application (LRA) for Perry Nuclear Power Plant (Perry),

Unit 1.

On July 21, 2022, the U.S. Nuclear Regulatory Commission (NRC, or the staff) held a public meeting with Energy Harbor to discuss the expected content of the upcoming submittal of the LRA for Perry with a focus on the environmental review. The slides for the staff presentation are available at ADAMS ML22199A023, and the slides for the applicants presentation are available at ADAMS ML22199A035. A similar meeting was held the same day, with a focus on the safety review. A summary of that meeting is available at ADAMS ML22213A036.

The NRC staff began with a brief overview of the license renewal (LR) process. The process consists of two tracks: an environmental review and a safety review. During the meeting, the staff shared a tentative review schedule. For an application submission date of July 2023, the tentative review schedule would be as follows:

R. Penfield 2 Energy Harbor provided their presentation involving Perry. In the development of the Perry LRA, Energy Harbor will benchmark against other successful LR and subsequent LR utilities and incorporate industry license renewal operating experience.

Following the presentations, NRC and Harbor representatives discussed a number of issues, including: whether the 2020 NPDES permit includes best technology available determinations pursuant to the Clean Water Act; if the applicant coordinated with the U.S. Fish and Wildlife Service concerning any of the species that they anticipate making "may affect but is not likely to adversely affect" findings, such as the piping plover; when the onsite cultural resource survey conducted; and if the licensee received any responses to the letters it sent to Tribes or State Historic Preservation Officers regarding license renewal.

Four members of the public asked questions and/or made comments on various topics, including:

- flooding and lake water levels

- groundwater tables

- population increases

- erosion control projects

- high-burnup fuel

- Native American tribes

- severe accident mitigation alternatives and design-basis accidents

- algae and thermal pollution

- fault lines and seismic monitoring

- emergency planning.
