Background:

Commission Orders On February 24, 2022, the Commission issued three orders (CLI-22-02, CLI-22-03, and CLI-22-04) addressing subsequent license renewal (SLR)

NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Revision 1 (the LR GEIS), issued 2013, does not apply to SLR Renewed licenses require further environmental review

- Peach Bottom Units 2 and 3

- Turkey Point Units 3 and 4 Further review needed for certain final supplemental environmental impact statement (SEIS) documents

- North Anna Units 1 and 2

- Point Beach Units 1 and 2 Further review needed for certain draft SEIS documents

- Oconee Units 1, 2, and 3

- St. Lucie Units 1 and 2 6

Background:

Commission Direction and Response

  • Also on February 24, 2022, the Commission issued an SRM (SRM-SECY-21-0066) directing the staff to develop a plan for a rulemaking that aligns with the Commissions orders regarding the National Environmental Policy Act (NEPA) analysis of SLR applications
  • The NRC staff submitted a revised rulemaking plan to the Commission (SECY-22-0024) on March 25, 2022
  • On April 5, 2022, the Commission issued SRM-SECY-22-0024, approving the staffs proposal and directing the staff to proceed with a 24-month rulemaking 7

Background:

SRM-SECY-22-0024 Amend Table B-1, Summary of Findings on NEPA Issues for License Renewal of Nuclear Power Plants, in Appendix B to Subpart A, Environmental Effect of Renewing the Operating License of a Nuclear Power Plant to 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions Remove the word initial from 10 CFR § 51.53(c)(3)

Update the LR GEIS and associated guidance to clarify their applicability to SLRs Conduct a thorough analysis of the environmental impacts of subsequent license renewal to expand the applicability of the LR GEIS Consider changes to applicable laws and regulations, new data, and experience in conducting similar environmental reviews; and update associated guidance for consistency 8

On April 25, 2022, NRC staff submitted a rulemaking plan to the Commission (SECY-22-0036) and recommended to defer the regular update for next 10-year cycle (Appendix B to Subpart A of 10 CFR Part 51 states that the Commission intends to review this Appendix on a 10-year cycle and update it, if necessary)

Provides options for future efforts to incorporate any changes determined to be necessary for the 10-year regulatory update cycle Would take place following the rulemaking approved by the Commission in SRM-SECY-22-0024 Would address new regulatory changes, new data or information obtained, lessons learned, and knowledge gained from license renewal environmental reviews performed after completion of the rulemaking described in SECY-22-0024 Staff would consider and incorporate NEPA and license renewal-related issues identified in SECY-21-0066 but deferred in the proposed rulemaking plan presented in SECY-22-0024 On June 17, 2022, the Commission issued SRM-SECY-22-0036 approving the staffs plan 9

Planned Path Forward The NRC intends to

  • rely on 10 CFR 51.41, Requirement to submit environmental information, to issue requests for additional information (RAI) and requests for confirmation of information (RCI), as appropriate, to obtain sufficient information to evaluate the environmental impacts of an SLR on a site-specific basis
  • review all applicable Category 1 (generic) issues listed in the applicable SEIS Table 4-1 for site-specific findings (e.g., SMALL, MODERATE, LARGE) using the methodology in the LR GEIS, as appropriate, and document staffs analysis 11

The NRC intends to

  • review applicable Category 2 (site-specific) issues listed in the applicable SEIS Table 4-2 for new information since the issuance of the site-specific draft or final SEIS and update site-specific analyses, as appropriate
  • issue a notice of availability that begins a limited scoping period (comments invited; no public meeting),

as appropriate

  • complete a (virtual) environmental audit, including issuing RAIs and RCIs, as appropriate 12 Planned Path Forward (continued)

The NRC intends to

  • issue a site-specific draft SEIS or draft SEIS supplement for public comment, and a notice of opportunity for hearing
  • issue a site-specific final SEIS or final SEIS supplement to provide staffs recommendation on whether to authorize the licensing action 13 Planned Path Forward (continued)
