WITHDRAWAL ACKNOWLEDGEMENT OF TEMPORARY EXEMPTION FROM ANNUAL FORCE-ON-FORCE EXERCISE REQUIREMENT OF 10 CFR PART 73, APPENDIX B, GENERAL CRITERIA FOR SECURITY PERSONNEL, SECTION VI, SUBSECTIONS C.3(I)(1) AND A.7 (EPID L-2022-LLE-0023 [COVID-19])
Dear Ms. Gerfen:
By letter dated June 29, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22180A299), you submitted an exemption request for Diablo Canyon Nuclear Power Plant, Units 1 and 2 (Diablo Canyon). The proposed request would have provided temporary exemption, due to the Coronavirus Disease 2019 (COVID-19) public health emergency, from Title 10 of the Code of Federal Regulations (10 CFR) Part 73, Appendix B, General Criteria for Security Personnel,Section VI, Nuclear Power Reactor Training and Qualification Plan for Personnel Performing Security Program Duties, subsection A.7, which provides the timeframe for conducting the force-on-force security drills for personnel security force qualification, as required by 10 CFR Part 73, Appendix B, Section VI, subsection C.3(I)(1).
By letter dated July 12, 2022 (ML22193A266), you requested to withdraw the application from U.S. Nuclear Regulatory Commission (NRC) review due to lower COVID-19 quarantine impacts, and the ability to maintain qualifications through performance of a force-on-force exercise. The NRC acknowledges your request to withdraw the application. The NRC staff activities on the review have ceased and the associated EPID number (L-2022-LLE-0023) has been closed.
