Dear Mr. Kamps:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your June 8, 2022, letter to Chairman Hanson where you express concerns regarding the return to operating status of Palisades Nuclear Plant (Palisades).
By letter dated June 13, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22164A067), in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 50.82(a)(1)(i), the NRC received certification that power operations ceased at Palisades on May 20, 2022. In addition, in accordance with 10 CFR 50.82(a)(1)(ii), it was certified that the fuel was permanently removed from the Palisades reactor vessel and placed in the Palisades spent fuel pool on June 10, 2022.
The regulation 10 CFR 50.82(a)(2) states the following:
Upon docketing of the certifications for permanent cessation of operations and permanent removal of fuel from the reactor vessel, or when a final legally effective order to permanently cease operations has come into effect, the 10 CFR part 50 license no longer authorizes operation of the reactor or emplacement or retention of fuel into the reactor vessel.
Therefore, the Palisades 10 CFR part 50 license no longer authorizes operation of the reactor or emplacement or retention of fuel in the reactor vessel. Furthermore, the NRC is not involved with any effort to return Palisades to power operations.
