By letter dated March 2, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21305A872), the U.S. Nuclear Regulatory Commission (NRC) informed you of its approval of the General Electric-Hitachi (GEH), Vallecitos Nuclear Centers, March 6, 2020, triennial update to the decommissioning funding plan (DFP) (ADAMS Accession No. ML20066J977), and supplemental information [i.e., letters dated June 2, 2020 (ADAMS Accession No. ML20154K650), January 12, 2022 (ADAMS Accession No. ML22012A148), and January 24, 2022 (ADAMS Accession No. ML22024A313), and electronic communication dated March 2, 2021 (ADAMS Accession No. ML21294A077)]. In its March 2, 2022, letter, the NRC staff requested that, in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Paragraphs 70.25(e)(1)(iv) and (v), within 30 days of the date of the letter, GEH must provide: (a) an updated copy of the DFP; (b) Certification of Financial Assurance (CFA); and (c) executed financial assurance instruments, including an updated Schedule A to its Standby Trust Agreement, to cover the full amount of the NRC-approved decommissioning cost estimate. In response, by letters dated March 23, 2022 (ADAMS Accession No. ML22084A578) and March 30, 2022 (ADAMS Accession No. ML22089A087),
GEH provided the Surety Bond Rider duplicate originals, and the updated DFP (which included GEHs updated CFA), respectively.
The NRC staff has completed its review of the submittals and determined that GEH has provided the requested documents in response to the NRC staffs March 2, 2022, letter. As such, all efforts under Enterprise Project Identifier number L-2020-DFA-0002 are now closed.
Enclosed please find public and non-public versions of Amendment 2 of Special Nuclear Materials License Number 960 (SNM-960) updating Safety Condition S-1(b) to include the March 6, 2020, triennial update to the DFP, the supplemental letters dated June 2, 2020, Documents transmitted by this letter contain Security-Related Information.
When separated from Enclosure 2, this letter and Enclosure 1 are decontrolled.
