WESTINGHOUSE ELECTRIC CO. LLC - REQUEST FOR ALTERNATE DISPOSAL AND EXEMPTIONS FOR COLUMBIA FUEL FABRICATION FACILITY WASTE DISPOSAL AT THE US ECOLOGY IDAHO FACILITY (ENTERPRISE PROJECT IDENTIFIER L-2021-LLA-0204)

On November 5, 2021, Westinghouse Electric Company, LLC (WEC) requested that the U.S. Nuclear Regulatory Commission (NRC) approve an alternate disposal request (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21309A095) under Title 10 of the Code of Federal Regulations (10 CFR)

Section 20.2002, Method for obtaining approval of proposed disposal procedures, for the disposal of specified low-activity radioactive materials from the Columbia Fuel Fabrication Facility. A correction to the request was submitted on December 1, 2022 (ADAMS Accession No. ML21336A461).

This request is for the disposal of certain low-activity radioactive materials, including byproduct and special nuclear material, from the Columbia Fuel Fabrication Facility. US Ecology, Inc., in coordination with WEC, requested corresponding specific exemptions from 10 CFR 30.3 and 10 CFR 70.3 pursuant to 10 CFR 30.11(a) and 10 CFR 70.17(a) (ADAMS Accession No. ML21351A038) to accept this material for disposal at the US Ecology Resource Conservation and Recovery Act Subtitle C disposal facility near Grand View, Idaho (USEI).

J. Zimmerman 2 The NRCs approval of the 10 CFR 20.2002 request and corresponding exemptions would allow WEC to transfer waste meeting the established criteria for disposal at USEI rather than requiring the disposal of the material in a 10 CFR Part 61 low-level waste disposal facility.

Enclosed is the staffs safety evaluation report (SER) for this request. In the SER, the NRC staff concludes that the requested alternate disposal of multiple individual shipments of different volumetrically contaminated and surface-contaminated waste at the USEI using the proposed bounding approach is acceptable under 10 CFR 20.2002.
