Dear Ms. Fosaaen,

By letter dated August 4, 2020, NuScale Power, LLC, (NuScale) submitted topical report (TR)-0915-17772, Methodology for Establishing the Technical Basis for Plume Exposure Emergency Planning Zones, (EPZ TR) Revision 2 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20217L422) for the U.S. Nuclear Regulatory Commission (NRC) staffs review. By letter dated December 23, 2021 (ADAMS Accession No. ML21348A004), the staff communicated the review status update, but did not include a proposed timeline or resource estimates for the conclusion of the TR.

NuScale and the NRC staff are currently continuing to work to resolve the remaining open item related to RAI 9828 issued in April 2021 (ADAMS Accession No. ML21116A110). The regulatory audit, which was originally scheduled to end on December 17, 2021 (ADAMS Accession No. ML21327A209) has been extended to March 31, 2022 via letter dated December 21, 2021 (ADAMS Accession No. ML21349A368). The audit was paused for the majority of January, but it resumed on January 24, 2022. During an audit meeting on January 27, NuScale proposed a modified version of one of the four viable options (Option

3) the staff indicated could resolve the remaining issue. However, to support this modified option, the staff requested that NuScale demonstrate its viability using an example calculation for its implementation of their proposed option. NuScale agreed and committed to complete this process by March 25, 2022.

The NRC staff will determine the change in staff resources and timeline for finishing its review of the NuScale EPZ TR after NuScale provides the EPZ audit deliverables on March 25th, and the staff has had a chance to review and digest the results, as discussed in the January 27, 2022, audit meeting.
