STATUS UPDATE ON REVIEW OF NUSCALE POWER, LLC, TOPICAL REPORT METHODOLOGY FOR ESTABLISHING THE TECHNICAL BASIS FOR PLUME EXPOSURE EMERGENCY PLANNING ZONES, TR-0915-17772, REVISION 2 (DOCKET NO. 99902043)
Dear Ms. Fosaaen:
By letter dated August 4, 2020, NuScale Power, LLC, (NuScale) submitted topical report (TR)-0915-17772, Methodology for Establishing the Technical Basis for Plume Exposure Emergency Planning Zones, Revision 2 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20217L422) (EPZ TR) for the U.S. Nuclear Regulatory Commission (NRC) staffs review. By letter dated April 2, 2021 (ADAMS Accession No. ML21084A123), the NRC staff informed you that Revision 2 of the TR was accepted for review and provided the updated schedule and resource estimates.
NuScale and the NRC staff are currently working to resolve the remaining open item related to RAI 9828 issued in April 2021 (ADAMS Accession No. ML21116A110). This remaining open item requests that NuScale provide a justification for their proposed seismic screening criteria in the EPZ TR. As a result of several public meetings for this item, an integrated team of NRC staff experts developed an independent and novel approach for screening seismic sequences.
The NRC staff has communicated this approach via four viable options to resolve the remaining issue at public meetings on October 27, 2021 and November 4, 2021 (ADAMS Accession No. ML21316A115). Following the public meetings, the NRC staff and NuScale agreed that additional technical discussions were needed, and the staff initiated a regulatory audit to discuss specific details related to the NRCs approach and options. This audit commenced on November 29, 2021 (ADAMS Accession No. ML21327A209).
At an audit discussion on December 9, 2021, NuScale identified the need to extend the regulatory audit, which was originally scheduled to end on December 17, 2021 (ADAMS Accession No. ML21327A209). This audit was extended to March 31, 2022, via letter dated December 21, 2021 (ADAMS Accession No. ML21349A368).
For resource planning purposes, NuScale has projected that it could: (1) resume the audit in the last week of January 2022 by providing the path forward and its technical basis; (2) submit draft revised RAI responses including proposed changes to the TR by the end of February 2022; and (3) submit the revised TR by the end of March 2022.
As a result of the extended audit and NuScales proposed schedule to address the remaining issue, the NRC has determined that this extended schedule will have schedule and staff

resource implications. Additionally, due to the extended schedule, the previously allotted review staff that will be needed for completing the EPZ TR review may not be available due to other high-priority work. The staff will attempt to minimize any potential delays in the completion of the review.
The staff will determine the change in staff resources and timeline for finishing its review of the NuScale EPZ TR based on NuScales selected option and/or approach to resolving the remaining issue at the end of January 2022.
