Dear Dr. Flaherty:

We have reviewed the final revisions to the Minnesota Radioactive Materials Rules, Chapter 4731, received by our office on January 14, 2022. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1, 2018-2, 2018-3, 2019-1, 2019-2, 2020-1, 2020-2, 2020-3, and other provisions not associated with a RATS ID (10 CFR Part 20, App. B, 32.51, 35.12 b(1) and c(1), 35.13(i),

35.14(a)) as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Brandon Juran on February 4, 2022.

As a result of our review we have one comment that has been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Minnesota in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Minnesota regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. Requirements for criminal history records checks of individuals granted unescorted access to category 1 or category 2 quantities of radioactive material The mail stop listed in § 4731.8025; Subp. 3 is incorrect. The mailstop has been changed to T-07D04M from T-8B20 (See STC-20-067).

Minnesota needs to replace the mailstop as indicated above in order to meet the Compatibility Category B designation assigned to § 10 CFR 37.27(c)(1) and (2).
