Dear Ms. Beckley:

We have reviewed the final revisions to the Nevada regulations 459.1997, 459.910, 459.1232, 459.977, 459.3062, 459.313, and 459.3125, received by our office on September 29, 2021.

These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2015-3 (10 CFR Part 71 incorporation by reference), 2015-4, and 2015-5 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on November 2, 2021.

As a result of our review, we have seven comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Nevada, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Nevada regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. 40. The correct reference should be to 10 CFR Part 40.

Nevada needs to correct the reference as indicated above to meet the Compatibility Category C designation assigned to 10 CFR 40.61(a)(2).

4 459.1997 71.85(a) - (c) 2015-3 NRC Preliminary determinations In Nevada section 459.1997(a), it states that the provisions of 10 CFR 71.83 to 71.89, inclusive, are adopted by reference. However, 10 CFR 71.85(a)-(c) are designated as Compatibility Category NRC and should not be adopted by reference.

Nevada section 459.1997 should be updated to exclude 10 CFR 71.85(a)-

(c) from the list of regulations adopted by reference to meet the Compatibility Category NRC designation assigned to 10 CFR 71.85(a)-(c).

5 459.910(2)(b) 459.1997, Attachment B 71.91(a), (c) and-(d) 71.91(b) 2015-3 C

NRC Records In the cross reference provided, Nevada states that the requirements of 10 CFR 71.91(a)-(b) are addressed in Nevada section 459.910(2)(b) which generically incorporates 10 CFR Part 71 by reference.

This section is duplicative and contradicts the provisions in Nevada section 459.1997, as provided in attachment B which state that the provisions of 10 CFR 71.91(c)-(d) are adopted by reference; Nevada needs to omit the statement in section 459.910(2)(b);

Also, 10 CFR 71.91(b) is designated as Compatibility Category NRC and should not be adopted by an Agreement State.

Nevada needs to omit 10 CFR 71.91(b) from the regulations that are adopted by reference.

6 459.1997 71.101(c)(2) 2015-3 NRC Quality assurance requirements Nevada section 459.1997(1) incorporates the entirety of 10 CFR 71.101(c). However, 10 CFR 71.101(c)(2) is designated as Compatibility Category NRC and should not be adopted by reference.

Nevada needs to omit 10 CFR 71.101(c)(2) from the list of regulations adopted by reference to meet the Compatibility Category NRC designation assigned to 10 CFR 71.101(c)(2).

7 459.1997 71.106 2015-3 C

Changes to quality assurance program Nevada regulations in section 459.1997 incorporate 10 CFR 71.106 by reference but does not substitute the term Division for NRC for 10 CFR 71.106.

Nevada needs to update section 459.1997 to specify that the term Division should be substituted for NRC in 10 CFR 71.106 since the State, not NRC should approve its licensees quality assurance programs.

Nevada needs to make the change indicated above to meet the Compatibility Category C designation assigned to 10 CFR 71.106.
