APPROVAL OF TRISO-X SAFEGUARDS PROTECTION PROGRAM

Dear Ms. Wheeler:

This is in response to your July 28, 2021, letter (Agencywide Documents Access and Management Systems (ADAMS) Accession Number ML21 217A135) as revised on August 21, 2021 (ADAMS Accession Number ML21245A286) requesting review and approval of the TRISO-X Facility Safeguards Information Plan (SIP).

On August 31, 2021, staff from the U.S. Nuclear Regulatory Commission (NRC) visited your facility to review the TRISO-X SIP, Revision 2, dated August 21, 2021. The site visit consisted of an inspection of the X Energy facility located in Oak Ridge, Tennessee, secure room and security storage container, examination of security structures, computer systems, equipment and components, interviews with site personnel, selective examinations of relevant procedures, and observations of site conditions and activities as they related to the protection of safeguard information (SGI).

Based upon the staffs review of TRISO -Xs revised SIP and conversations with authorized personnel, including you as the approved reviewing official, the NRC has determined that TRISO-X has provided sufficient assurance that it will protect the SGI entrusted to it in accordance with the requirements of Title 10 of the Code of Federal Regulations (10 CFR)

Sections 73.21 and 73.22.

In accordance with 10 CFR, S ection 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this communication will be available electronically for public inspection in the NRC Public Document Room, or from the NRCs ADAMS. The ADAMS database is accessible from the NRC Web site at http://www.nrc.gov/reading -rm/adams.html.
