IDAHO STATE UNIVERSITY APPLICATION FOR RENEWAL OF SPECIAL NUCLEAR MATERIALS LICENSE NUMBER 1373 - REQUEST FOR SUPPLEMENTAL INFORMATION - ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2021-NFR-0000

Dear Dr. Lybecker:

By letter dated July 9, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML21190A245), you submitted an application for renewal of Special Nuclear Materials License Number 1373 (SNM-1373) for the Idaho State University (ISU).

The U.S. Nuclear Regulatory Commission (NRC) staff performed an acceptance review of your application to determine if the application contains sufficient technical information in scope and depth to allow the staff to complete the detailed technical review. This letter is to advise you that, based on our acceptance review, the application does not contain sufficient technical information to proceed with its detailed technical review. Therefore, the NRC staff is declining to proceed with a detailed technical review, and is providing ISU the opportunity to supplement the application by addressing the issues discussed in the enclosure to this letter.

This letter confirms our discussions during the September 8, 2021, teleconference with respect to ISUs application and the supplemental information needed to proceed with its review. As discussed during the call, we request that the supplemented application be provided within 60 days from the date of this letter.

The ISU filed its license renewal application at least 30 days before the licenses expiration date of August 11, 2021, pursuant to the timely renewal provisions in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 70.38(a). Therefore, ISU is permitted to continue using its special nuclear material in accordance with the existing SNM-1373 license, pending a final decision by the Commission on the license renewal application.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
