Josh, Below is DRAFT request for additional information (RAI) for the Wolf Creek exemption request from the biennial emergency preparedness exercise. Please let me know if you need a clarification call. In addition, we should discuss a RAI response date. We should plan on an RAI response by August 13, 2021, to support your requested schedule. Background:

By application dated July 29, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21210A450), Wolf Creek Nuclear Operating Corporation (WCNOC or the licensee) requested a one-time scheduler exemption to postpone the Wolf Creek Generating Station (WCGS) calendar year (CY) 2021 full participation biennial emergency preparedness (EP) exercise until CY 2022.

Basis for RAI:

In its application, the licensee provides the following information in support of an expedited

review,

• A statement from responsible OROs [offsite response organizations] that they agree with the exemption request and they are committed to maintaining their radiological emergency plans; o The OROs agree with WCNOCs exemption request and are committed to maintaining their radiological emergency plans.

Enclosed with this attachment are letters from Coffey County, KDHE [Kansas Department of Health and Environment], and KDEM [Kansas Division of Emergency Management] in support of the exemption. [emphasis added]

• A statement from the responsible OROs that they are not impacted in a manner that would adversely affect their ability to maintain response capability to support emergency response activities to actual nuclear power plant radiological emergencies.

o As described in the enclosed letters, the OROs continue to work closely with WCNOC and the state to maintain response capabilities in the event of an actual emergency at WCGS.

However, the enclosed letters from Coffey County, KDHE, and KDEM do not explicitly state that they are committed to maintaining their radiological emergency plans, or that they are not impacted in a manner that would adversely affect their ability to maintain response capabilities in the event of an actual emergency at WCGS.

Please provide additional documentation to support these statements in the application. This documentation can be in the form of an email or letter that will be docketed by the NRC.
