Specifically, pursuant toTitle 10oftheCodeof Federal Regulations (10 CFR),

Part 50,Paragraph 50.55a(z)(1),

DENC proposed that supplemental valveposition verification beperformed ata frequency consistent withthe10 CFR 50,AppendixJ,TypeCtesting interval forthevalves within thescopeofthe request.

Inanemail dated June21,2021, the NRCissued adraft request foradditional information (RAI) related totheproposed alternative request. OnJune29,2021,theNRCstaff conducted aconference call with DENC staff toclarify therequest.

Applicable Regulation andGuidance Theregulations in10CFR50.55a(f)(4),

"Inservice testing standards requirementfor operating plants,"

states, inpart, that valves that arewithinthe scope oftheASMEOM CodemustmeettheISTrequirements setforth intheASMEOM Code; andthat valves that arewithin thescopeoftheASMEOMCode,butarenotclassified asASMEBoiler andPressure Vessel CodeClass 1,2,or3,maybesatisfied aspartof an augmented IST program.

Theregulations in10CFR50.55a(z)

state, inpart, that alternatives totherequirements inparagraphs (b) through (h) of10CFR50.55a maybeauthorized bytheNRC ifthe licensee demonstrates that:

(1) theproposed alternative provides anacceptablelevel of quality andsafety, or(2) compliance withthespecified requirements would result in hardship orunusual difficulty without acompensating increase inthelevel ofquality and safety.

Inorder forthestaff todetermine iftheproposed alternative maybeauthorized pursuant to10CFR50.55a(z)(1),

thestaff requests thelicensee provide thefollowing additional information.

ASMEOMCode,Subsection ISTC,"Inservice Testing ofValves inWater-Cooled Reactor Nuclear PowerPlants,"

paragraph ISTC-3700, "Position Verification Testing,"

as incorporated byreference in10CFR50.55a, states thefollowing:

Valves with remote position indicators shall beobserved locally atleast onceevery 2years toverify thatvalve operation isaccurately indicated.

Wherepracticable, this local observation should besupplemented byother indications suchasuseof flow metersorother suitable instrumentation toverify obturator position.

Wherelocal observation isnotpossible, other indications shall beusedforverification ofvalve operation.

Whenimplementing paragraph ISTC-3700, "Position Verification Testing,"

inthe ASMEOMCode, 2012 Editionthrough thelatest edition andaddenda oftheASME OM Codeincorporated byreferenceinparagraph (a)(1)(iv) ofthis

section, licensees shall verify that valve operationisaccurately indicated bysupplementing valve position indicating lights with other indications, suchasflow meters orother suitable instrumentationto provide assurance ofproper obturator position for valves withremote position indication within thescopeofSubsection ISTC including itsmandatory appendices and their verification methodsand frequencies.

RAl-1 Inits March24,2021,submittal, thelicensee states that for certainvalves atMPS3,10 CFRPart50,Appendix J,"Primary Reactor Containment Leakage Testing forWater-Cooled PowerReactors,"

TypeCLocal LeakRateTesting (LLRT) iscredited tomeetthe supplemental position verification closure testing portionof the requirements inASME OMCode,Subsection ISTC,paragraph ISTC-3700, and10 CFR 10.55a(b)(3)(xi). The licensee states that itadopted the10CFRPart50,Appendix J, Performance-Based, Option

BProgram, consistent with Nuclear Energy Institute 94-01,Revision 3-A,"Industry Guideline forImplementing Performance-Based Option of10CFRPart 50, Appendix J,"

forMPS3.Thelicensee notesthat this program allows LLRTintervalsto be extended up to75monthsforvalves with ahistory ofsatisfactory testing.

Inits submittal, the licensee proposes analternative totheASMEOMCode,Subsection

ISTC, paragraphISTC-3700 close position requirements, toperform thevalve supplemental position verification ata frequency consistent with10CFRPart 50,Appendix J,TypeCtesting (LLRT) forMPS3.

TheNRCstaff requests that thelicensee describe theactivities that provide anaccurate verification oftheclose positions oftheapplicable valves.

M Forthevalves inthescopeoftheMPS3request foralternative, 10CFR50,Appendix J,

TypeCtesting (LLRT) will beperformed tomeetthesupplemental position verification (SPV) closure testing requirement.

ISTC-3540 isapplicable tomanually operated

valves, andstates
inpart, that thevalves "shall exhibit therequired change ofobturator position."

ISTC-3700 isapplicable tomotorandpneumatically operated

valves, andstates
inpart, thatindications should "verify obturator position."

DENChasconcluded that meeting the quantified valveleakage acceptance criteria ofthe10CFR50,Appendix J,test requirements will sufficiently verify that thevalve obturator isaccurately positioned as

closed, thusmeeting theintent ofISTC-3540 andISTC-3700 onthealternative frequency

A satisfactory LLRTwasperformed duringthe 3R20 outage(in October of2020) fortheapplicable valves.

Itshould be noted thattheMPS3request foralternative doesnotchange thefrequency oftheSPVtesting intheopendirection.

Fortheapplicable

valves, afrequency ofevery 2years isretained for open SPVtesting.

Additionally, theMPS3request foralternative doesnotchange the frequency ofPosition Indication Testing (PIT) ineither theopenor closed direction.

Thefrequency ofPITremains every 2years.
