OYSTER CREEK NUCLEAR GENERATING STATION - EXEMPTION FROM ANNUAL FORCE-ON-FORCE EXERCISE REQUIREMENT OF TITLE 10 OF THE CODE OF FEDERAL REGULATIONS PART 73, APPENDIX B (EPID: L-2021-LLE-0032)

Dear Ms. Sterdis:

The Commission has approved the enclosed exemption from certain specific requirements of Title 10 of the Code of Federal Regulations (10 CFR), Part 73, Appendix B, for the Oyster Creek Nuclear Generating Station (OCNGS). This action is in response to your request dated June 3, 2021 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML21161A289), as supplemented on June 8, 2021 (ADAMS Accession No. ML21162A362).

The request is for the U.S. Nuclear Regulatory Commission (NRC) to approve an exemption from the requirement to conduct 2021 annual force-on-force (FOF) exercises including the requirements for the Performance Evaluation Program, defined by 10 CFR Part 73, Appendix B, Section VI, Subsection C.3.(I). As granted, the exemption eliminates the requirements for the Performance Evaluation Program, including the requirements to conduct annual FOF exercises and quarterly tactical response drills, in 10 CFR Part 73, Appendix B, Section VI, Subsection C.3 for OCNGS. The exemption from these requirements is appropriate for OCNGS as all spent nuclear fuel is on the Independent Spent Fuel Storage Installation pad, as of May 21, 2021 (ADAMS Accession No. ML21160A065), stored in approved dry storage containers.

A copy of the exemption is enclosed. The exemption will be forwarded to the Office of the Federal Register for publication.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS).
