OYSTER CREEK NUCLEAR GENERATING STATION - ISSUANCE OF AMENDMENT TO CHANGE THE EMERGENCY PLAN AND EMERGENCY ACTION LEVEL SCHEME TO REFLECT AN ISFSI-ONLY CONFIGURATION (EPID NO. L-2021-LLA-0025)

Dear Ms. Sterdis:

The U.S. Nuclear Regulatory Commission (NRC) has issued the enclosed Amendment No. 300 to Renewed Facility Operating License No. DPR-16 for the Oyster Creek Nuclear Generating Station (Oyster Creek). The amendment consists of changes to the Renewed Facility Operating License in response to your application February 23, 2021 (Agencywide Documents Access and Management System [ADAMS]) Accession No. ML21054A321), as supplemented by letter dated April 30, 2021 (ADAMS Accession No. ML21120A110).

The amendment replaces the Oyster Creek Permanently Defueled Emergency Plan and associated Permanently Defueled Emergency Action Level (EAL) Technical Bases Document (hereafter referred to as the EAL scheme) with an Independent Spent Fuel Storage Installation (ISFSI) Only Emergency Plan (IOEP) and associated EAL scheme. The changes will reflect the new status of the facility, as well as the reduced scope of potential radiological accidents, once all spent fuel has been moved to dry cask storage within the onsite ISFSI. On May 25, 2021, Holtec Decommissioning International, LLC (the Licensee) submitted a letter (ADAMS Accession No. ML21145A261) certifying that all spent fuel is now located on the ISFSI on site.

This change reflects the complete removal of all fuel from the spent fuel pool and permits specific reductions in the size and makeup of the Emergency Response Organization due to the elimination of the design basis accident related to the spent fuel (fuel handling accident).

The NRC staff determined that the proposed Oyster Creek ISFSI Only Emergency Plan and associated EAL changes would continue to meet the standards in Title 10 of the Code of Federal Regulations (10 CFR), Section 50.47, Emergency plans, and the requirements in Appendix E, Emergency Planning and Preparedness for Production and Utilization Facilities, of 10 CFR Part 50, Domestic Licensing of Production and Utilization Facilities, as exempted.

As such, the Oyster Creek IOEP and associated EAL changes would provide reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency at the Oyster Creek facility.

A copy of the amendment is provided in Enclosure 1. A copy of the related Safety Evaluation is provided in Enclosure 2. The Notice of Issuance will be forwarded to the Federal Register for publication.
