Dear Mr. Forsee:

We have reviewed the proposed revisions to the proposed Illinois 32 Ill. Adm. Code Parts 330 and 335, received by our office on May 4, 2021. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1 and 2020-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on June 8, 2021.

As a result of our review, we have nine comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Illinois regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Illinois regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other Illinois regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Illinois needs to replace reference to 335.9150 with a reference to 335.7100(b).

Illinois needs to make the above change to meet the Compatibility Category B designation assigned to 10 CFR 35.2 2

Training for Radiation Safety Officer and Associate Radiation Safety Officer In Illinois Section 335.9010(a) it states, Is certified by a specialty board whose certification process has been recognized by the Agency, the U.S. Nuclear Regulatory Commission or an Agreement State and who meets the requirements described in subsection (f)

The reference to subsection (f) should be replaced by a reference to subsection (e).

Illinois needs to make the above changes to meet the Compatibility Category B designation assigned to 10 CFR 35.50.

3 330.260(c)

(20) and 35.57 2018-1 B

Training for experienced Radiation Safety Officer, teletherapy or medical physicist, authorized

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS 335.9160 medical physicist, authorized user, nuclear pharmacist, and authorized nuclear pharmacist.

Illinois 330.260(c)(20)(A) states in part that, An individual identified on an Agency, U.S. Nuclear Regulatory Commission, or an Agreement State license need not comply with the training requirements of subsection (c)(17) or (c)(18), respectively, except the Radiation Safety Officers identified in subsection (c) shall meet the training requirements in subsection (c)(17)(D).

In the statement above:

Illinois needs to replace the reference to (c)(17) or (c)(18) with references to 335.9010, 335.9150, or 330.260 (c)(18); and Illinois needs to replace the reference to subsection c in the phrase, Radiation Safety Officers in subsection c so that the phrase reads, Radiation Safety Officers in this paragraph, and Illinois needs to replace the reference to subsection (c)(17)(D) with references to 335.9010(e) or 335.9150(d) such that the phrase reads, meet the training requirements in 335.9010(e) or 335.9150(d).

In summary, Illinois 330.260(c)(20)(A) should read:

Illinois needs to make the above changes to meet the Compatibility Category B designation assigned to 10 CFR 35.57.

Training for uptake, dilution, and excretion studies.

Illinois 335.9060(c)(3)(1) states in part, A signed by a preceptor authorized user who meets the requirements in this Section, Section 335.9050, 335.9070, 335.9160 or equivalent U.S. Nuclear Regulatory Commission or Agreement State requirements.

Illinois needs to remove the phrase, A signed by at the beginning of the statement so that the statement reads, A preceptor authorized user who meets the requirements in this Section, Section 335.9050, 335.9070, 335.9160 or equivalent U.S. Nuclear Regulatory Commission or Agreement State requirements.

Illinois needs to make the above change to meet the Compatibility Category B designation assigned to 10 CFR 35.392.
