U.S. Nuclear Regulatory Commission Public Meeting Summary May 21, 2021

Title:

Public Meeting to Discuss the American Society of Mechanical Engineers 2019-2020 Code Editions Proposed Rule Meeting Identifier: 20210432 Date of Meeting: May 6, 2021 Location: Slide Presentation via Microsoft Teams Type of Meeting: Comment-Gathering Meeting Purpose of the Meeting(s):

The purpose of this meeting was to provide information about an upcoming proposed rule to incorporate by reference American Society of Mechanical Engineers (ASME) codes into the U.S. Nuclear Regulatory Commission (NRC) regulations, in Section 50.55a, Codes and standards, of Title 10 of the Code of Federal Regulations (10 CFR). Specifically, the NRC intends to incorporate by reference the 2019 Edition of the ASME Boiler and Pressure Vessel Code (BPV Code),Section III, Division 1, and Section XI, Division 1, and the 2020 Edition of ASME Operation and Maintenance of Nuclear Power Plants, Division 1, OM Code: Section IST (OM Code). The NRC also intends to incorporate by reference the 2011 Addenda to ASME Standard NQA-1-2008, Quality Assurance Requirements for Nuclear Facility Applications, (ASME NQA-1b-2011), and the 2012 and 2015 Editions of ASME Standard NQA-1.

The proposed rule was published in the Federal Register on March 26, 2021 (86 FR 16087).

The public comment period is open through May 25, 2021.

General Details:

The meeting was noticed on the NRC public website (see meeting notice and agenda listed under References below).

The meeting was scheduled from 1:00 p.m. - 3:00 p.m. and adjourned a few minutes early, after the conclusion of the question and answer period.

Representatives included participants attending the ASME BPV Code Week, representatives of licensees, vendors, and industry interest groups, and interested members of the public.

In total, there were approximately 93 participants in this meeting. Incoming feedback was received from the attendees that participated either by phone or online using Microsoft Teams. A partial list of those attendees who logged into Microsoft Teams is provided as an attachment to this meeting summary.

Summary of NRC Presentation:

The meeting began with a discussion of the purpose and overview of the meeting. Next, information regarding the scope and schedule of the ASME 2019-2020 Code Editions rulemaking was presented, after which detailed technical presentations were delivered by the NRC staff. After each presentation section, the NRC staff opened the meeting for questions and comments from the public, explaining that the comments and suggestions provided by the attendees would be considered in preparing the final rule, but that all comments would have to be submitted on the docket in writing using one of the methods described in the Federal Register notice in order to receive formal consideration during the rulemaking process.

Ms. Victoria Huckabay, Project Manager, Division of Rulemaking, Environmental, and Financial Support, NRC Office of Nuclear Materials Safety and Safeguards, provided opening remarks and presented information regarding the status of the ASME 2019-2020 Code Editions rulemaking. Ms. Huckabay discussed the two methods for submitting written comments outlined in the Federal Register notice. Next, Ms. Huckabay provided an overview of the rulemaking process and discussed the timeline of the last several published Code Edition and Addenda rulemakings. Ms. Huckabay noted that the ASME 2019-2020 Code Editions final rule is expected to be published in the Federal Register by June 30, 2022.

The first technical presentation was provided by Dr. Chakrapani Basavaraju, Mechanical Engineer, Division of Engineering and External Hazards, and focused on the incorporation by reference of the 2019 Edition of ASME BPV Code,Section III, Division 1. The presentation included a discussion of a new proposed condition on Section III rules related to preservice inspection of steam generator tubes. The presentation also included a discussion on proposed revisions to four existing conditions on Section III rules.

The second presentation was provided by Mr. Yamir Diaz-Castillo, Reactor Operations Engineer, Division of Reactor Oversight, and focused on proposed revisions to two conditions related to Quality Assurance: one condition on Section III rules and another on Section XI rules.

The third presentation was provided by Mr. Keith Hoffman, Materials Engineer, Division of New and Renewed Licenses, and focused on the incorporation by reference of the 2019 Edition of the ASME BPV Code,Section XI. The presentation discussed the staffs plans to revise six existing conditions on Section XI rules. The presentation also included a discussion of one new proposed condition on Section XI rules, which is a condition stipulating regulatory submittal requirements for certain analyses.

In the fourth presentation, Mr. Robert Wolfgang, Senior Mechanical Engineer, Division of Engineering and External Hazards, provided a discussion focused on the incorporation by reference of the 2020 Edition of the ASME OM Code. The presentation discussed the staffs plans to remove the incorporation by reference of the 2011 Addenda and the 2015 Edition of the ASME OM Code and the corresponding revisions to existing conditions on the OM Code rules. The presentation also discussed the staffs plans to clarify the relationship between 10 CFR 50.55a(f)(4) and 10 CFR 50.55a(g)(4) regarding Inservice Testing (IST) and Inservice Inspection programs for snubbers. The staff also discussed the proposed addition of a new condition that would require applicants and licensees to submit IST Plans and interim IST Plan updates related to pumps and valves, and IST Plans and interim Plan updates related to snubber examination and testing, to the NRC. Further, Mr. Wolfgang discussed a proposed relaxation of the interval for position verification testing for valves not susceptible to stem-disk separation. The presentation concluded with a discussion of an editorial change to the condition in 10 CFR 50.55a(b)(3)(iii) which would revise the applicability date.

Public Participation Comments and Questions:

After each section of the staffs presentation, members of the public in attendance were provided with an opportunity to ask questions and provide comments. Questions and comments were offered by industry stakeholders Gary Park of Iddeal Solutions, Thomas Basso of the Nuclear Energy Institute (NEI), Christopher Koehler of Xcel Energy, Ken Lowery of Southern Nuclear Operating Company, Mark Gowin of Tennessee Valley Authority (TVA),

Thomas Loomis of Exelon Nuclear, Glenn Weiss of Exelon Nuclear, Jeffrey Stumb of Dominion Energy, and Bob Hoke of Exelon Corporation. They discussed several topics of interest and asked follow-up questions and provided comments related to specific aspects of the proposed changes discussed by the staff.

Questions and comments discussed by the public included, but not were not limited to:

(1) the proposed revision of the condition on pressure testing of mechanical joints; (2) condition (b)(2)(xviii)(D)(2) regarding the number of experience hours required for Level II certification; (3) the applicability of proposed new condition (b)(2)(xliii) regarding regulatory submittal requirements; (4) use of condition (b)(2)(xxv) on mitigation of defects by modification; (5) condition (b)(3)(xi) regarding the valve position indication; (6) the condition regarding the interim reporting of the IST Plans; (7) the timing of the IST program plan submittals; and (8) the requirements of paragraph (f)(4) related to IST standards for dynamic restraints (snubbers). In addition, a few questions and comments were received regarding various provisions in 10 CFR 50.55a that are not within the scope of this rulemaking.

The NRC staff expressed their appreciation for the stakeholder feedback provided during the meeting and encouraged the meeting participants to submit their comments on the docket in writing.
