OYSTER CREEK NUCLEAR GENERATING STATION - REQUEST FOR APPROVAL OF INDEPENDENT SPENT FUEL STORAGE INSTALLATION ONLY PHYSICAL SECURITY PLAN - ACCEPTANCE REVIEW (L-2020-LLA-0267)

Dear Ms. Sterdis:

By letter dated December 8, 2020 (Agencywide Documents Access and Management System

[ADAMS]) Accession No. ML20345A249 and ML20345A260 (non-public, withheld under Title 10 of the Code of Federal Regulations [10 CFR] Part 2.390), Holtec Decommissioning International, LLC (HDI) submitted a request for amendment to the operating license (OL) for Oyster Creek Nuclear Generating Station (OCNGS). Specifically, HDI is requesting approval of the OCNGS Independent Spent Fuel Storage Installation (ISFSI) Security Plan, Training and Qualification Plan and Safeguards Contingency Plan and removal of 10 CFR 73.55 requirements directly from the OL.

The U.S. Nuclear Regulatory Commission (NRC) staff performed an acceptance review of your request to determine if it contains sufficient technical information to allow the NRC staff to conduct further technical review. Based on the acceptance review of your submittal, the NRC staff has determined that additional technical information is needed to proceed with a detailed technical review. As such, the NRC staff is declining to accept the submittal until we receive HDIs responses to the request for supplemental information (RSI), discussed below, describing the specific information that is needed to proceed with the detailed technical review.

The regulation at 10 CFR 50.12, Specific Exemptions, states that the Commission will not consider granting an exemption unless special circumstances are present. Special circumstances are present when compliance is not necessary to achieve the underlying purpose of the rule. Based on the statement of consideration, the staff interprets the underlying purpose of 10 CFR 50.54(w) was to ensure the licensee has adequate resources to stabilize the site and control radioactivity release following an unlikely event involving significant damage to fission product barriers.

A. Sterdis Physical Security Plan (PSP)

The NRC staff request that HDI provide the following information:

1) The OCGNS ISFSI PSP does not address how this PSP will meet the requirements of NRC Order EA-02-104. This information is needed to meet the requirements of NRC Order EA-02-104.
2) The OCGNS PSP contains figures and diagrams of the Oyster Creek ISFSI layout that are blurred. This information is needed to determine compliance with 10 CFR 73.55(a)-

(r), and NRC Order EA-02-104.

The response to the RSI should be provided within 30 business days from the date of this letter.

The NRC staff held a teleconference on December 17, 2020 to discuss the RSI and ensure mutual understanding. After we receive a response to the RSIs, we will provide an anticipated completion date and work hours estimate for our formal review.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS).
