We have reviewed the proposed revisions to the Oregon regulations Chapter 333, Divisions 102, 116, 118, and 125, received by our office on November 13, 2020. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1 and 2018-2 as identified in the enclosed State Regulation Status (SRS)

Data Sheet. We discussed our review of the regulations with you on December 11, 2020.

As a result of our review, we have nine comments related to compatibility, and four editorial comments that have been identified in the enclosure. Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Oregon regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Oregon regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other Oregon regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Training for Radiation Safety Officer and Associate Radiation Safety Officer Oregon needs to make the following changes:

(1) In the introductory sentence of 333-116-0640 add the phrase or an individual assigned duties and tasks as an Associate Radiation Safety Officer after Radiation Safety Officer; (2) For OAR 333-116-0640(1), delete the reference to section (5) so that it reads requirements in section (4) of this rule; (3) In 333-116-0640(2)(g) add a U.S.

Nuclear Regulatory Commission before the word Authority so that it reads on a U.S. Nuclear Regulatory Commission, or Authority, or Agreement State license in the first sentence; (4) For 333-116-0640(3)(b), add the phrase a permit issued by a Commission or an Agreement State licensee of broad scope, after Agreement State license; and (5) For 333-116-0640(3)(b), insert the words licensee seeks the approval of after the words material for which so that it reads material for which the licensee seeks the approval of the individual as the RSO Oregon needs to make the above changes to 333-116-0640 in order to meet the Compatibility Category B designation assigned to 35.50.

(1) In (1) remove the reference to subsection (2)(b) and the word and; (2) Add Commission to the reference to U.S. Nuclear Regulatory, and add State after the word Agreement so that it reads recognized by the U.S. Nuclear Regulatory Commission or an Agreement State; (3) Add the words under this section after the word recognized so that it reads recognized under this section by the U.S in 333-116-0905(1)(A); and (4) In the first sentence of 333-116-0905(2)(b), remove the word function before independently and add the phrase fulfill the radiation safety-related duties after the word independently, so that it reads, is able to independently fulfill the radiation safety-related duties as Oregon needs to make the above changes to 333-116-0905 to meet the Compatibility Category B designation assigned to 10 CFR 35.51.
