We have reviewed the proposed revisions to the South Carolina regulations R.61-63, Radioactive Materials (Title A), received by our office on October 28, 2020. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1, 2018-2, 2018-3, 2019-1, 2019-2, 2020-1, and 2020-2, as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on November 13, 2020.

As a result of our review, we have 15 comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the South Carolina regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final South Carolina regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS)

Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other South Carolina regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. RHA 4.2.4 4.2.23 35.2 2018-1 B

Definitions: Associate Radiation Safety Officer and Ophthalmic Physicist SC referenced NRC regulations in its definitions for Associate Radiation Safety Officer and Ophthalmic physicist. SC needs to replace references to §35.50 with RHA 4.20; to §35.59 with RHA 4.24; and to

§35.433(a)(2) with RHA 4.52.1.2 in each of the definitions.

SC needs to make the above changes in order to meet the compatibility category B designation assigned to 10 CFR 35.2 Definitions: Associate Radiation Safety Officer and Ophthalmic physicist.

Training for an authorized nuclear pharmacist SC deletes the word State after the word Agreement in the beginning of the first sentence of RHA 4.22.1.

SC needs to add the word State in the first sentence of 4.22.1 in order to meet the compatibility category B designation assigned to 10 CFR 35.55.

3 RHA 4.40 35.300 2018-1 B

Use of unsealed byproduct material for which a written directive is required SC lists an incorrect reference in RHA 4.40. SC needs to remove RHA 4.43.4.3.6 and replace it with RHA 4.43.2.2.7.

SC needs to make the above change in order to meet the compatibility category B designation assigned to 10

Training for use of unsealed byproduct material for which a written directive is required SC omits the word any in front of radioactive in RHA 4.43.2.2.7.3.

SC lists an incorrect reference in 4.43.2.3.1. SC needs to change the beginning of RHA 4.43.2.3.1 to read, A preceptor authorized user who meets the requirements in 4.23, 4.43, or equivalent NRC or Agreement State requirements SC lists an incorrect requirement in 4.43.2.3.2. SC needs to change the beginning of 4.43.2.3.2 to read, A residency program director who affirms in writing that the attestation represents the consensus of the residency program faculty where at least one faculty member is an authorized user who meets the requirements in 4.23, 4.43, or equivalent NRC or Agreement State requirements SC needs to make the above changes in order to meet the compatibility category B designation assigned to 10 CFR 35.390.

5 RHA 4.45 35.394 2018-1 B

Training for the oral administration of sodium iodide I-131 requiring a written directive in quantities greater than 1.22 gigabecquerels (33 millicuries)

SC omits NRC or before Agreement State requirements in 4.45.3.7.2.

SC needs to make the above change in order to meet the compatibility category B designation assigned to 10 CFR 35.394.

Training for use of manual brachytherapy sources In RHA 4.54.2.2, SC needs to change the reference in the last part of the sentence from RHA 4.4.6 to RHA 4.46.

SC needs to make the above change in order to meet the compatibility category B designation assigned to 10 CFR 35.490.

7 RHA 4.55 35.491 2018-1 B

Training for ophthalmic use of strontium-90 SC needs to add or Agreement State between NRC and requirements in RHA 4.55.4.

SC needs to make the above change in order to meet the compatibility category B designation assigned to 10 CFR 35.491.

8 RHA 4.57 35.590 2018-1 B

Training for use of sealed sources and medical devices for diagnosis.

SC references incorrect regulations in RHA 4.57.1.1. The first sentence should read, Is certified by a medical specialty board whose certification process includes all of the requirements in RHA 4.57.3 and 4.57.4 of this section SC needs to make the above change in order to meet the compatibility category B designation assigned to 10 CFR 35.590.

9 RHA 4.61 35.610 2018-1 H&S Safety procedures and instructions for remote afterloader units, teletherapy units, and gamma stereotactic radiosurgery units SC references an incorrect regulation

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS in RHA 4.61.7. RHA 4.61.7 should read, A licensee shall retain a copy of the procedures requires by RHA 4.61.1.4 and 4.61.4.2.2.

SC needs to make the above change in order to meet the compatibility category H&S designation assigned to 10 CFR 35.610.

10 RHA 4.74 35.690 2018-1 B

Training for use of remote afterloader units, teletherapy units, and gamma stereotactic radiosurgery units SC needs to add or Agreement State between NRC and requirements in RHA 4.74.2.2 and 4.74.2.3.

SC needs to make the above change in order to meet the compatibility category B designation assigned to 10 CFR 35.690.

11 RHA 4.120 35.3204 2018-1 C

Report and notification for an eluate exceeding permissible molybdenum-99, strontium-82, and strontium-85 concentrations SC needs to change RHA 4.120.1 to have the licensee notify the Department by telephone instead of the NRC. Additionally, the second paragraph should reflect what the telephone report to the Department must include.

SC needs to make the above changes in order to meet the compatibility category C designation assigned to 10 CFR 35.3204.

12 N/A 70.32 2018-2 C and H&S Conditions of Licenses SC omits equivalent regulations to 10 CFR 70.32(a)(2), (a)(3), (a)(8), and (a)(9).

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS SC needs to incorporate equivalent provisions into its regulations in order to meet the compatibility category C designation assigned to 10 CFR 70.32(a)(2), (a)(3), and (a)(8); and the compatibility category H&S designation assigned to 10 CFR 70.32(a)(9).

13 RHA 12.23.1.1 37.77(a)(1) 2018-3 B

Advanced notification of shipment of category I quantities of radioactive material SC removes Division of Material Safety, State, Tribal, and Rulemaking Programs from RHA 12.23.1.1, however, SC does not insert the text Division of Materials Safety, Security, State, and Tribal Programs in its place for whom a list of contact information is available upon request.

SC needs to add the correct Division title to rule RHA 12.23.1.1 in order to meet the compatibility category B designation assigned to 10 CFR 37.77(a)(1).

Personnel Monitoring SC omits the phrase, must be retained after results and before until the Department in RHA 5.14.7.3.

SC needs to make the above change in order to meet the compatibility category C designation assigned to 10 CFR 34.47.

EDITORIAL COMMENT STATE SECTION COMMENT R.61-63 SCs references to the NRC are used inconsistently throughout R.61-63, i.e., NRC, Commission, US Nuclear Regulatory Commission. In addition, SC does not define the term Commission.

To avoid confusion, SC should use a consistent and defined term for the NRC in its regulations.
