UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 September 24, 2020 Mr. Daniel Mannis Radiation Safety Officer Environmental Safety and Occupational Health (DIR-ES)

Defense Threat Reduction Agency 8725 John J. Kingman Rd., Stop 6201 Ft. Belvoir, VA 22060-6201

SUBJECT:

DEFENSE THREAT REDUCTION AGENCY-ACCEPTANCE REVIEW OF PART 70 APPLICATION FOR SPECIAL NUCLEAR MATERIALS LICENSE (ENTERPRISE PROJECT IDENTIFICATION CODE L-2019-NEW-0005)

Dear Mr. Mannis:

By correspondence dated August 21, 2020 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML20238B813), you provided an application for a Special Nuclear Materials (SNM) License in accordance with the requirements of Title 10 of the Code of Federal Regulations, (10 CFR) Part 70, Domestic Licensing of Special Nuclear Materials.

The U.S. Nuclear Regulatory Commission (NRC) staff has performed an acceptance review of your submittal to determine if the application contains sufficient technical information to allow the NRC staff to conduct a detailed technical review. Based on this review, the NRC staff concludes the submittal contains information in sufficient detail to enable the staff to conduct its detailed review. Accordingly, the NRC staff has established a schedule for this review which includes the issuance of requests for additional information (RAIs) by December 12, 2020. The NRC staff anticipates completing its review and developing a Safety Evaluation Report to address the submittal by the end of October 2021. This schedule is based on an adequate response to one round of RAIs. Incomplete or inadequate answers to RAIs, requiring request for further information will cause delay in issuing a license on that schedule. In addition, the NRC staff estimates that completing the review and making an independent assessment of the proposed application beyond the site visits already completed, will require approximately 350 staff hours at $279 per hour, or approximately $97,650.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

D. Mannis 2 If you have any questions, feel free to contact Tyrone Naquin at (301) 415-7352, or via e-mail to Tyrone.Naquin@nrc.gov.

Sincerely, Tyrone D. Naquin, Project Manager Fuel Facility Licensing Branch Division of Fuel Management Office of Nuclear Material Safety and Safeguards Docket No.: 70-7029 License No.: SNM-7005
