UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 September 21, 2020 Mr. Bill Halliburton, Administrator Cimarron Environmental Response Trust c/o: Environmental Properties Management, LLC.

9400 Ward Parkway Kansas City, MO 64114

SUBJECT:

APPROVAL TO REALLOCATE FUNDS IN CIMARRONS 2020 BUDGET

Dear Mr. Halliburton,

By letter dated August 28, 2020, 1 the Cimarron Environmental Response Trust requested 0F approval to reallocate funds previously approved in the 2020 Cimarron Budget. 2 This letter 1F documents the U.S. Nuclear Regulatory Commission (NRC) staffs approval of this request.

In its August 28 submittal, Environmental Properties Management (EPM) requested NRCs approval to deviate from the approved budget. The scope of work and budget for Enercon Services (Enercon) in the 2020 Cimarron Budget includes $53,000 for license compliance support, a portion of which is for revision of the decommissioning plan (DP). Funding is not sufficient to complete Enercons scope of work, for the reasons described in EPMs August 28 submittal. EPM requested approval to transfer excess 2020 Cimarron Budget funding from Veolia Nuclear Solutions - Federal Services or Burns & McDonnell (for work which must be deferred due to the time required to revise the DP) to fund Enercons scope of work.

The NRC approves of the reallocation of funds, i.e., the deviation from the approved budget to allow Enercon to complete the proposed scope of work request. This letter does not constitute NRCs approval of the proposed revisions to the DP, which are included in the Scope of Work section of EPMs August 28 submittal. When EPM submits the revised DP, the NRC will complete an acceptance review and, if the NRC accepts the DP for detailed technical review, then the NRC will make a DP approval determination after completion of its detailed technical review. Based on a teleconference to discuss the Cimarron Site status, held on September 15, 2020, you confirmed that the NRC should put on hold the NRC review of two current license amendment requests, related to the Decommissioning Activities, until Cimarron has identified the path forward. Therefore, the NRC has halted review of the associated License amendment requests November 2, 2018, 3 and the November 22, 2019. 4, until the path 2F 3F forward is identified.

In accordance with Title 10 of the Code of Federal Regulations Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records 1 Agencywide Documents Access and Management System (ADAMS) Accession No ML20247J557.
