SUMMARY

OF AUGUST 13, 2020, PUBLIC MEETING WITH NEXTERA ENERGY POINT BEACH, LLC REGARDING A PROPOSED LICENSE AMENDMENT REQUEST FOR THE POINT BEACH NUCLEAR PLANT, UNIT 1, CONTAINMENT BUILDING TRUSS LICENSE CONDITION CHANGE DUE TO THE CORONAVIRUS DISEASE (COVID-19) (EPID L-2020-LRM-0075)

On August 13, 2020, a Category 1 public meeting was held between the staff of the U.S. Nuclear Regulatory Commission (NRC) and representatives of NextEra Energy Point Beach, LLC (NextEra, the licensee), via teleconference. The purpose of the meeting was to discuss NextEras forthcoming license amendment request (LAR) to modify the Point Beach Nuclear Plant (Point Beach), Unit 1, license condition 4.I, Containment Building Construction Truss, by extending associated implementation items (on a one-time basis) for another 18 months to the spring 2022 Refueling Outage (RFO). The extension request by NextEra is due to unforeseen circumstances related to the effects of the coronavirus disease (COVID-19) pandemic. The meeting notice and agenda, dated August 3, 2020, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20218A272. A list of attendees is enclosed.

There were no supporting files, documents, or associated correspondence, provided to the NRC staff by NextEra for the presentation.

Introduction NextEra discussed that due to the unpredictable nature of the COVID-19 pandemic, NextEra does not want to potentially expose and jeopardize the health and safety of team members.

NextEra has determined that by reducing the number of employees required for the Unit 1 (Cycle 39) RFO and the outage scope and duration would thereby reduce the probability of spread of COVID-19 and ensure the safe operation of Units 1 and 2.

The NextEra staff discussed the following topics: (1) the existing Unit 1 containment construction truss license conditions, (2) the Unit 1 construction truss spatial modifications, (3) Unit 1 piping supports, (4) Updated Final Safety Analysis Report (UFSAR) revision to delineate truss construction code provisions, and (5) justification for the proposed Unit 1 license condition extension.

Discussion The NRC staff and NextEra discussed that Point Beach, Unit 1, is currently operating under license conditions that require certain modifications to the Unit 1 containment construction truss system in order to be in conformance with the units licensing bases. The licensee has until the completion of the fall 2020 Unit 1 RFO to meet its licensing requirements as set forth by license Amendment No. 263, issued to NextEra on March 26, 2019 (ADAMS Accession No. ML18340A088). The associated safety evaluation included license conditions for the Unit 1 spatial clearance modifications, modifications of spray piping support, and implementation of seismic limits to drive shutdown inspection(s) of truss.

The NRC staff and NextEra discussed the proposed LAR which modifies Point Beach, Unit 1, operating license condition 4.I, Containment Building Construction Truss, by extending elements of the condition, on a one-time basis, for 18 months to spring 2022, which coincides with the Unit 1 (Cycle 40) RFO. Specifically, NextEra discussed a request to extend its current license condition 4.I, implementation items 1, 2, and 6, which are (1) spatial clearance modifications, (2) modification to containment spray pipe supports, and (6) UFSAR revision to reflect the as-built plant. NextEra characterized items 1 and 2 as plant configuration modifications and item 6 as an administrative task.

NextEra noted that Amendment No. 263, license condition 4.I (referenced above), includes implementation items 3 and 5, which are not impacted by the proposed LAR.

The NRC staff and NextEra discussed that by license Amendment No. 263, which established the 4.I license conditions, the staffs determinations were on the bases of risk-informed decision-making. The staff discussed with NextEra the five principles of regulation as referenced in Regulatory Guide 1.174, Revision 3, An Approach for Using Probabilistic Risk Assessment in Risk-Informed Decisions on Plant-Specific Changes to the Licensing Basis.

NextEra acknowledged the staffs approach used for the Amendment No. 263 issuance and stated the proposed LAR will not be a risk-informed application. The licensee stated that previous NRC engineering and risk-based conclusions and determinations remain valid.

NextEra stated that the Unit 1 truss structure and supported/adjacent equipment, in the current condition, remain operable but nonconforming to the original design code of record for associated design basis events/accidents. This is unchanged by the requested extension, which is being proposed to reduce worker exposure to the effects of the virus.

Conclusion The NRC staff stated that it will perform a thorough review of the proposed LAR and make the appropriate regulatory decisions in a timely manner. There were no final regulatory decisions made during the meeting since the discussion focused primarily on projected licensing activities and scheduling and allowed NextEra to inform the staff of the forthcoming request due to COVID-19 impacts. No members of the public were identified on the teleconference, hence, there were no public questions/comments during the public portion of this discussion. Public Meeting Feedback forms were available, no comments were received.
