SALEM NUCLEAR POWER PLANT EMERGENCY-

RESPONSE EXERCISE ON MARCH 3,'1998 I am surprised and confused by your memorandum of January 30,1998. .,

J Surprised, because this is an "old" issue, with advance notice given to you and all

' Commissioners beginning with my memorandum of September 23,'1997, one-on-one meetings, and communications with AEOD. After i retumed from Mexico (December 7, 1997), I confirmed my interest in the next full' exercise and that neither you nor the other Commissioners had expressed an interest. I even personally informed Mr. Stoiber, OlP, of the potential activity. In January 1998, I personally obtained assurances from ,

Mr. Martin that all. requirements were satisfied, including consultation with the EDO.

Then, and only then, did I send the invitations to the foreign officials to participate as observers, as a professional courtesy to those officials, with whom I am personally acquainted. You did not meet with me in the period of November 12,1997 -

January 20,1998.

Confused, because I believe I have followed existing procedures and customary practices. I have failed, after receiving your memorandum, to find any procedures that .

-exclude U.S. Nuclear Regulatory Commissioners from fostering intemational relations.

Additionally, I did not find limitations in the law or intemal Commission procedures addressing participation by the Commission or individual Commissioners in the necessary processes to establish policy on and be fully cognizant of emergency preparedness.

Therefore, I believe the Commission should engage the mechanisms at its disposal to clarify these matters.~
