1. Background On.0ctober 18, 1988, Consumers Power Company (CPC) submitted a 10 CFR Part 21 report to the NRC regarding questionable valve trim replace-ment parts, which typically include the valve stem, plug or disc, cage, seat ring, and retention pin, for its Masoneilan-Dresser (M-D) valves.

CPC identified approximately 65 questionable valve-trim parts after a M-D service. technician brought some suspect parts that were found in a turbine bypass valve at the Palisades Nuclear Plant to CPC's attention.

Two years previous, CPC had sent the subject turbine bypass valve to a M-D valve facility for refurbishment. They also sent M-D the . correct valve trim, since it was an in-stock warehouse item. After the valve was refurbished, reinstalled, and the plant started operation, CPC dis-covered that the turbine bypass valve continued to leak. However, CPC decided to operate with the leakage and resolve the problem during its 1988 refueling outage. CPC contracted with M-D for its 1988 outage to provide on site technical support for valve refurbishment.

During the 1988 turbine bypass valve refurbishment, the M-D technician identified dimensional and metallurgical discrepancies in the valve trim parts that were previously installed at the M-D facility and addi-tionally identified problems with the new valve trim parts that were to be installed. Subsequent CPC investigations determined that the author-ized M-D distributor, S-W Controls, procured many of the valve trim components from manufacturers / suppliers that were not authorized by M-D to make the parts. Two companies have been identified as manu-facturing replacement valve trim parts without authorization from M-D:

Control Valve Speciality Company (CVS) and COR-VAL, both located in

A third company, GEMOCO, also located in Houma, Louisiana, has been identified as advertising replacement parts for M-D valves. M-D has indicated that GEM 0C0 is also not an authorized manufacturer or distributor of M-D parts.

On November 18, 1988, M-D transmitted a letter to the NRC staff dis-cussing the above issues. The letter identifies a potential for failure of M-D valves if parts manufactured by unauthorized companies are installed by the end users (licensees). The letter also indicates that the suspect parts are typically' procured as commercial grade and dedicated by the licensee for use in safety-related systems.

The 10 CFR Part 21 Palisades report and the M-D letter have brought into question the functionality of valves that have valve trim components installed that were not manufa'ctured by an authorized company. This issue may not be limited to M-D valves, but could include other manufacturer's valves.

2. Discussion On December 1, 1988, the NRC inspection team met with the president of S-W Controls, Mr. Bill Sample, at the S-W Controls facili! / in Livonia, Michigan. The NRC team leader explained that the NRC was conducting an unannounced inspection of S-W Controls as a result of a 10 CFR Part 21 notification by CPC on October 18, 1988. The CPC 10 CFR Part 21 notification addressed potentially suspect (non-genuine) replacement parts supplied by S-W Controls for Masoneilan valves installed in the Palisades Nuclear Power Plant. The NRC team leader stated that the team wished to review the S-W Controls quality pro-gram, purchase orders, and other related documentation that may be pertinent to the NRC's evaluation of the CPC 10 CFR Part 21 notifica-tion. During the course of the inspection, various discussions occurred between the NRC inspection team and Mr. Sample. A summary of the major topics covered in these discussions is presented below:
a. S-W Controls (formerly Sample-Webtrol Controls) is an authorized representative for Masoneilar valves for specific geographic areas in Michigan and Ohio. The office in Livonia handles purchase orders from CPC for Palisades and Big Rock Poir.t Nuclear Power Plants. As an authorized Masoneilan representative, S-W Controis is not allowed to handle other valve competitor's product lines.
b. S-W Controls does not use a formal, documented quality program.

Personnel are trained on the job and follow policies and proce-dures that have evolved with time.

c. Purcnase orders are received from S-W Controls customers and are processed by the S-W Controls inside sales personnel.

With respect to nuclear orders from CPC, S-W Controls filled past orders by either initiating a purchase order to Masoneilan, the original equipment manufacturer (0EM), or initiating a p.urchase order to a secondary source manufacturer (e.g., CVS orCOR-VAL). Mr. Sample stated that the following S-W Controls policy has been used to guide the internal decision on how to fill a particular CPC order:

(1) Safety-related Orders. These are processed by initiating a purchase order with Masoneilan. Secondary-source manu-facturers were not used to fill any nuclear safety-related orders. Orders that were not identified as safety-related were treated as commercial orders. Purchase order reviews indicate that the commercial grade replacement parts were shipped directly to CPC from COR-VAL and CVS.

(2) Commercial Orders. Commercial orders for Itasoneilan valve parts were handled in one of two ways:

(a) Cenmercial Order Requiring Certification Documentation.

Tole commercial orders required certification documen-tation such as a certificate of compliance or a certi-fied material test report. All commercial orders that required certification documentation were filled by initiating a purchase order with l'asoneilan. Secondary source manufacturers were not used to fill any of these orders.

(b) Commercial Orders With No Requirements For Certification Documentation. These orders could be filled by initia-ting a purchase order with Masonellan or by initiating a purchase order with a secondary source manuf acturer.

In a number of cases, S-W Controls initiated orders ,

with secondary sour;e manufacturers. Mr. Sample noted I that parts ordered by SW fron a secondary source manu-facturer are not dropshipped. Instead, they will be shipped into the S-W Controls facility. However, a review of purchase orders to COR-VAL and CVS revealed that some of the parts were shipped directly to CPC by C0h tAL and CVS.

providing timely delivery of replacement parts for their valves. To eliminate the bottleneck, Masoneilan licensed l

CVS to start manufacturing and supplying replacement valve trim parts. Masoneilan then advised S .W Controls and its  ;

other distributors to obtain replacement parts from CVS.

S-W Contrels began to use CVS to fill commercial orders for Masoneilan valve parts following this notification.

(2) In about 1981, Masoneilan_ terminated the license agreement with CVS. However, CVS continued to produce valve trim and S-W Controls continued to buy some valve trim parts for Masoneilan valves from CVS. S-W Controls also ordered a few replacement valve parts for Masoneilan valves from COR-VAL, another secondary source manufacturer.

(3) Mr. Sample stated that all parts purchas.r from CVS or COR-VAL since 1973 were commercial grade. According to Mr.

Sample, these commercial grade parts were used by him to fill only commercial customer orders from CPC that did not require special certification documentation,

e. The NRC team asked M . Sample whether CPC knew they were receiving secondary source replacement parts for th:ir Masoneilan valves.

He said he did not k10w whether CPC was aware. The NRC team questioned Mr. Sauple on whether the secondary cource parts were represented as beint, manufactured by Mas neilan, rir. Sample stated that his cortpany did nothing explicit to repre;ent the parts as being inanufactured by Masoneilan. However, his company ,

also did not ideatify that the parts were not manufactured by Masoneilan. Ti'e NRC team noted that CPC may have thought they were receiving Masoneilan manufactured replacement parts because they were ordering the parts from an authorized Masoneilan repre-sentative. Additionally, the part identification was typically identified on the S-W Controls invoices as, P/N XXXX, Masoneilan valve stem,

f. The NRC team asked whether there was any special way of distin-guishing between a part manufactured by Masoneilan and the same part manufactured by a secondary source manuf acturer. He stated that, in general, one would probably not be able to distinguish the differences by simply looking at the part. However, he stated that current Masoneilan supplied parts are typically packaged and labelled with a part number and the Masoneilan name and logo. The parts obtained from secondary source

The HP,C team observed some examples of this during a tour of the S-W Controls parts storage area. Mr. Sample stated that none of the secondary source parts were supplied to CPC with either the Masoneilan name or the Masoneilan logo nn the tags.

g. Mr. Sample stated that he was very concerned about the questions that had arisen with respect to supplying secondary source manufactured parts to CPC. However, he stated that to his knowledge, the quality of the seco:idary source manufacture parts supplied by his company has never been questioned. Further, he noted that nothing in the S-W Controls contractual relationship with Masoneilan prohibited the use of secondary source manufacturers.

Additionally, he noted that nothing in the purchase order requirements from CPC prohibited S-W Controls from using secondary source manufacturers. Mr. Sample did'say that because of the large amount of effort required by all parties to evaluate the overall issue, S-W Controls will no longer use secondary source manufacturers to fill orders for

-0EM equipment replacement parts.

h. Mr. Sample stated that many companies in the country are involved in supplying replacement valve parts for valves originally manufactured by someone else. Further, he stated that secondary source manufacturers for valve , arts is just the tip of the iceberg. A larger secondary source market exists for many other typ2s of related equipment such as pumps (e.g., impe11ers). Additionally, the secondary source market is common in other industries. Mr. Sat.ple also noted that another entire side of the issue is that OEM replacement parts could be purchased by the OEM from the ame secondary source manufacturers that provide parts to companies such as S-W Controls.
3. Purchase Order Review. The NRC team reviewed a number of S-W Controls purchase order documentation packages for CPC orders to more fully understand the nature of the procurement and identify how S-W Controls filled these particular orders.

Details associated with the review are presented below. In gencral, this review substantiated that these orders were handled in accordance with the policy and procedures explained by Mr. Sample during the course of the inspection,
