UPDATE TO THE 1985 COL 0kADO RADIATION CONTROL PROGRAM REVlEW Subsequent to the 1985 review of the Colorado Department of Health, Radiation Control Division (CDH/ RCD) and to the receipt of the Department's response letter of February 4,1986, the NRC provided the State of Colorado with a finding of adequacy and compatibility by letter dated March 28, 1986.

As discussed in my April 3, 1986, memorandum to file, two indicators, " Staffing Level" I cud " Technical Quality of Licensing Actions" were to be followed up by July 1986.

On July 27-28, 1986, several discussions were held with Messrs. Hazie and Jacobi to obtain an update on current program activities. The results of these discussions are as follows:

The implementation of '40 CFR 192 continues to be a primary concern in the lawsuits taken under CERCLA. The resolution of the lawsuits may result in concentrations below levels specified in the NRC regulations. Both CERCLA lawsuits continue to address removal of contamination. Source control has been and will continue to be an important component of contemplated remedial actions at the CERCLA sites (Uravan and Cotter). A settlement to both cases is anticipated this year. On August 1, 1986, a briefing is scheduled for Cotter Corporation. On September 9, 1986, a " Consent Decree" will be lodged with the courts for Uravan. Subsequent to the completion of court activities, public comments vill be solicited. According to Mr. Hazle, a target date of October 1, 1986, is anticipated for a resolution to Cotter Corporation litigation. No date has been set for Uravan.

The current staffing level at the CDH/ RCD for the uranium mil'1 program continues to remain as documented during the review (.97 staff years per uranium mill). Mr. Jacobi stated that two positions have been allotted and funded foi " uranium mill program for the State's current fiscal year.

Eowever, the positions have not been filled until qualified candidates have applied and been selected.

It was agreed that the CDH/ RCD management would continue to keep SGAS informed of the continuing CERCLA activities.
