SUBJECT: NOTICE'0F VIOLATION (INSPECTION REPORT 50-458/89-17)
Gentlemen:
iThis refers to the inspection conducted by Mr. H. Chaney of this office'during
the period April 9-19, 1989, of activities authorized by NRC Operating
License NPF-47 for River Bend Station, and to the discussion of our findings.
.with'you and other members of your staff at the conclusion of the inspection.
Areas examined during the inspection included portions of the radiation
protection program and planning and preparations for the in-reactor vessel feed
water sparger repairs. Within these areas, the inspection consisted of
selective examination of procedures and representative records, interviews with
personnel,'and' observations by the NRC inspector.
The inspection findings are
documented in.the enclosed inspection report.
During this inspection, it was found that certain of your activities were in
violation of NRC requirements. The state of South Carolina identified several
violations of NRC and Department of Transportation requirements' involving a
licensee radioactive waste shipment (0788-019) received at the Chem-Nuclear
Systems, Inc. burial facility at Barnwell, Suuth Carolina on July 14, 1988. We
note that these violations have already been the subject of enforcement action
by the state of South Carolina. A civil penalty in the amount of Two Thousand-
Five Hundred Dollars ($2,500) was assessed and your-authorization to utilize
the Barnwell facility was temporarily suspended until compliance.was
reestablished with Department of Transportation and state of South Carolina
requirements. One of the violations in the enciesed Notice of Violation has-
been classified at Severity Level III in accordan:e with Supplement V of
Appendix C to 10 CFR Part 2 and would normally be the subject of possible
escalated enforcement action.
In view of the enforcement action already taken
by the state of South Carolina, and based on a review of the specifics of the
violations, your expedient actions to evaluate and correct the problems, and
your previous enforcement history in this area, no enforcement action other.
than the issuance of the enclosed Notice of Violation is being considered.
Ycur corrective actions to the aforementioned violations appear to tu adequate
.to prevent a recurrence of the violations in the future. Accordingly, you are
not. required to respond to these transportation violations.
