t APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Company (GSU) Docket: 50-458/89-17 River Bend Station (RBS) License: NPF-47.

During an NRC inspection conducted during April 9-19, 1989, two violations of NRC requirements were identified. These violations were originally identified by the state of South Carolina. The violations involved the failure to comply with NRC and Department of Transport.ation requirements during the shipment of radioactive waste. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

Shipment of Radioactive Waste to Barnwell, South Carolina

1. Description of Hazardous Material on Shipping Papers 10 CFR Part 71.5 requires, in part, that "Each licensee who transports licensed material outside of the confines of its plant or . . . delivers licensed material to a carrier for transport, shall comply with the applicable requirements of the regulations appropriate to the mode of transport of DDT in 49 CFR Parts 170 through 189 "

49 CFR Part 172.203(a) requires, in part, that: "The description for a shipment of radioactive material must include the following additional entries as appropriate . . . (iii) The Activity contained in each package of the shipment in terms of . . . millicuries."

Contrary to the above, the NRC determined on April 19, 1989, that the licensee had made a shipment (0788-019) of solidified resins to the Chem-Nuclear Systems, Inc., waste burial site at Barnwell, South Carolina.

The shipment arrived at Barnwell on or about July 15, 1988, and was found to contain approximately 53,000 millicuries of radioactivity versus the 13.8 millicuries stated on the shipment manifest. The licensee had alerted the burial site on July 14, 1988, that the shipment may have a higher millicurie content than stated on the manifest.

This is classified as a Severity Level III Violation. (Supplement V)

2. Classification of Wastes on Hazardous Waste Manifests 10 CFR Part 20.311(b) requires, in part, that: "Each shipment of radioactive waste to a licensed land disposal facility must be accompanied by a shipment manifest that contains the . . . as completely as possible the description of the waste . . . radionuclides identity and quantity; the total radioactivity . . . Waste containing more that 0.1 percent chelating agents by weight must be identified and the weight percentage of the chelating agent estimated. (c) Each manifest must include a certification by the waste generator that the transported materials are properly classified, described, packaged, and marked . ."

Contrary to the above, the NRC inspector determined on April 19, 1989, that the manifest for Waste Shipment 0788-019 listed "none present" for chelating agents when actually the shipment contained 4.1 percent chelating agents, and the accompanying radiological analysis did not ,

accurately describe the radionuclides identity and quantity.

This is considered a Severity Level IV Violation. (Supplement IV)

The NRC inspector has discussed the above violations with the licensee and reviewed the licensee's response to the state of South Carolina (J. Booker, GSU L to H. Shealy, South Carolina Dept. of Health and Environmental Control, Serial No. RBG-28462, File Code G1.11.2, dated August 16,1988), and found that the licensee's corrective actions were expedient, comprehensive, and should be effective in preventing a recurrence of these violations in the future.

Therefore, no written response to this Notice of Violation is required.
