SUBJECT: NRC INSPECTION REPORT 50-361/97-24; 50-362/97-24

Dear Mr. Ray: i

An NRC inspection was conducted Novemtier 17-21 and December 3-5,1997, at your San

Onofre Nuclear Generating Station, Units 2 and 3 reactor facilities. The enclosed report presents

the scope and results of that inspection.

Based on the results of this inspection, five apparent violations were identified and are being

considered for escalated enforcement action in accordance with the " General Statement of Policy

and Procedure for NRC Enforcement Actions(Enforcement Policy), NUREG-1600. The

apparent violations involved the failure to: (1) protect safeguards information, (2) provide a

backup power supply, (3) secure contingency weapons, (4) report security events, and

(5) implement proper compensatory measures. Accordingly, no Notice of Violation is presently

being issued for these inspection findings. In addition, please be advised that the number and

characterization of apparent violations described in the enclosed inspection report may change

as a result of further NRC review.

A predecisional enforcement conference to discuss these apparent violations has been

scheduled for January 20,1998, at 1 p.m. in Ariington, Texas. The decision to hold a

predecisional enforcement conference does not mean that the NRC has determined that a

violation has occurred or that enforcement action will be taken. This conference is being held to

obtain information to enable the NRC to make an enforcement decision, such as a common

understanding of the facts, root causes, missed opportunities to identify the apparent violation

sooner, corrective actions, significance of the issues and the need for lasting and effective

corrective action. In addition, this is an opportunity for you to point out any errors in our inspec-

tion report and for you to provide any information conceming ~y our perspectives on 1) the severity

of the violations,2) the application of the factors that the NRC considers when it determines the

amount of a civil penalty that may be assessed in accordance with Section VI.B.2 of the

Enforcement Policy, and 3) any other application of the Enforcement Policy to this case, including

the exercise of discretion in accordance with Section Vll. Because safeguards information may

be discussed, this conference will not be open to public observation. ,

These apparent violations appear to be repetitive or similar to past violations. With respect to

the issue of failing to protect safeguards information, NRC Inspection Report 50-361/95-15;

50-362/95-15 noted five other instances of failing to protect safeguards information, including two

lost safeguards documents. For each of the apparent violations involving the failure to provide a

backup power supply, failure to secure contingency weapons, and failure to implement proper

compensatory measures, more than one instance occurred. Additionally, the apparent violation

involving a failure to report security events involved multiple examples, and NRC Inspection

Report 50-361/95-15; 50-362/95-15 noted that numerous items had not been documented in the

safeguards event log. Accordingly, we request that you specifically address why past corrective

actions may not have been fully effective in preventing these problems from occurring.

Although not identified as an example of the apparent violation involving a failure to report, we

request that you specifically address your views regarding the deportability of unlocked

safeguards contingency weapons containers. Finally, we request that you address the actions

you have taken or planned to enhance the reliability of the security computer.

You will be adviscd by separate correspondence of the results of our deliberations on this matter,

No response regarding these apparent violations is required at this time.

The material enclosed herewith contains safeguards information as defined by 10 Cl R

Part 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the

Atomic Energy Act of 1954, as amended. Therefore, the material will nol be placed in the Public

Document Room.
