REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, HOPE CREEK GENERATING STATION - CYCLE 8/ RELOAD 7 CORE OPERATING LIMITS REPORT (TAC NO. MAC802)

Dear Mr. Keiser By Public Service Electric and Gas Company's letter (LR-N97781) dated December 17,1997, and General Electric Company's (GE) affidavit executed by Glen A. Watford, dated December 5, 1997, you submitted the Hope Creek Generating Station Cycle 8/ Reload 7 Core Operating Limits Report, NFS-0162, Revision O. Your letter identifies that Attachment 3 to the letter (" Lattice-Dependent MAPLHGR Report for Hope Creek Generating Station, Reload 7, Cycle 8," GE report 24A5392AA, Revision 0, dated May 1997) contains information of a proprietary nature to GE and requests that it be withheld from public disclosure pursuant to 10 CFR 2.790.

GE stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(a)

Inforrnation that discloses a process, method, or apparatus, including supporting data and analyses, where prevention ofits use by General Electric's competitors without license from General Electric constitutes a competitive economic advantage over other companies.

(b)

Information which, if used by a competitor, would reduce [the] expenditure of resources or improve [the] competitive position in the design, manufacture, shipment, installation, assurance of quality, orlicensing of a similar product.

(c)

The information identified in [ Attachment 3 to letter LR-N97781] is classified as proprietary because it contains details of GE's fuel system analysis and the corresponding results which GE has applied to this specific core design with GE's fuel.

The development of the methods used in (this] analysis, along with the testing, development and approval of the supporting data was achieved at a significant cost, on the order of several million dollars, to GE.

information contained in the report should not be exempt from mandatory public disclosure and should be released and placed in the Public Document Room (PDR). The specific information l

that we believe should not be exempt from mandatory public disclosure is listed in the enclosure to this letter along with the reasons for our conclusions.

Therefore, we request that you resubmit a proprietary version of GE report 24A5392AA with the information sought to be withheld specifically identified within 30 days of receipt of this letter. In j

addition, a non-proprietary version should also be submitted to allow for proper docketing j

pursuant to 10 CFR 2.790(b)(1)(i). Upon receipt of this information, we will proceed with our l

determination as to whether the GE report should be withheld from public disclosure.
