ENCLOSURE 1 NOTICE OF VIOLATION I Florida Power Corporation Docket No. 50-302 Crystal River Unit 3 License No. DPR-72 During the Nuclear Regulatory Commission (NRC) inspection conducted on February 25 - March 31,1989, violations of NRC requirements were identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

A. Technical Specification 6.8.1 requires the implementation of written procedJres for those activities recommended in Appendix "A" of Regulatory Guide 1.33, November 1972 and for surveillance procedures.

Regulatory Guide 1.33, Appendix "A", Section C.19 recommends procedures for startup and shutdown of emergency diesel generators.

Surveillance procedure SP-354A, Monthly Functional Test of the Emergency Diesel Generator EDG-1A, step 9.1.1 requires that the post maintenance valve lineups of procedure OP-707 be completed.

Operating procedure OP-707, Emergency Diesel Generator Miscellaneous.

Activities, valve checklist #3 requires starting air system valve EGV-35 to be in the open position.

Contrary to the above, on March 16, 1989, during the performance of procedure SP-354A to start the emergency diesel for an overspeed trip test, valve EGV-35 was observed to be in the closed position even though step 9.1.1 of procedure OP-707 had been signed off as completed.

This is a Severity Level IV Violation (Supplement I).

8. Technical Specification 6.8.1.c requires the establishment and implementation of written procedures for surveillance activities of safety related equipment.

Surveillance procedure SP-184, Sodium Hydroxide Flow Verification, Section 4, specifies temporary flanges and piping necessary to be installed and the valve lineup necessary to perform this test.

Contrary to the above, on March 16, 1989, procedure SP-184 was not properly established in that the valve lineup specified by the procedure did not check any vent or drain valves. This resulted in a spill of approximately five gallons of caustic sodium hydroxide from an open vent valve.

This is a Severity Level IV Violation (Supplement I).

Florida Power Corporation 2 Docket No. 50-302 Crystal River Unit 3 License No. DPR-72 Pursuant to the provisions of 10 CFR 2.201, Florida Power Corporation is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, Crystal River 3, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) admission or denial of the alleged violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
