Executive Vice President One Upper Pond Road Parsippany, NJ 07054 Gentlemen:
By letter dated August 25,1988 (4410-88-L-0131/0118P), your Corporation requested an exemption from the annual fee requirements of 10 CFR 171 for FY 1989 for Three Mile Island Unit 2 (TMI-2). As in your exemption requests for FY's 1987 and 1988, it is your position that TMI-2's license is comparable to a " possession only" license since the reactor is incapable of generating electricity and the authority to operate the reactor was revoked by NRC in 1979.
We have completed our review of your request and have taken into consideration the data presented therein and the fact that by application dated August 16, 1988, GPU requested:
1.
authority to implement the proposed Post-Defueling Monitored Storage plant configuration which was proposed in December 1986, and 2.
that License No. OPR-73 for TMI-2 be reduced to a " possession only" license.
Since the TMI-2 reactor is in a " shutdown and defueled mode"; request has been made to implement the proposed Post-Defueling Monitored Storage plant configuration, and a request for a " possession only" license has been filed and is under NRC consideration, we have determined that an exemption from the requirements of 10 CFR 171 for TMI-2 is appropriate and is hereby granted pursuant to the provisions of 10 CFR 171.
This exemption is applicable for FY 1989 and thereafter until the license is amended to be a " possession only" license for TMI-2 at which time the facility would automatically be excluded from the current fee requirements of 10 CFR 171.
