Gentlemen:
SUBJECT: NOTICE OF VIOLATION
(NRC INSPECTION REPORT NOS. 50-321/89-06 AND 50-366/89-06)
This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by
Messrs. J. E. Menning and R. A. Musser on March 21 - April 21,1989. The
inspection included a review of activities authorized for your Hatch facility.
At the conclusion of the inspection, the findings were discussed with those
members of your staff identified in the enclosed Inspection Report.
Areas examined during the inspection are identified in the report.
Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observation of
activities in progress.
The inspection findings indicate that certain activities appeared to violate
NRC requirements.
Violation 366/89-06-05, references to pertinent
requirements, and elements to be included in your response are presented in the
<
enclosed Notice of Violation.
Although this violation was identified by the
licensee, it is being cited because it could have been prevented by corrective
action for a previous violation.
The deficient procedure that caused the
violation had been upgraded as part of your Procedure Upgrade Program, and this
program was identified as a long-term corrective action for a previous
violation.
Additionally, because all of the criteria for categorization of
licensee-identified violations were met with regard to items 321/89-06-01,
321/89-06-02, 366/89-06-03, and 366/89-06-04, four other violations are not
being cited.
Therefore, no response to these four items is required.
The
details pertaining to these licensee-identified violations are described in the
enclosed Inspection Report.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,
Title 10, Code of Federal Regulations, a copy of this letter and its enclosures
will be placed in the NRC Public Document Room.
The responses directed by this letter and its enclosures are not subject to the
clearance procedures of the Office of Mat.agement and Budget as required by the
Paperwork Reduction Act of 1980, Pub. L. No.96-511,
