WESTINGHOUSE REPORT WCAP-12151: APPLICATION FOR WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE By letter dated March 7,1989 from Mr. George S. Thomas, New Hampshire Yankee Division (NHY), provided Enclosur.e 1, a Westinghouse report entitled, " Assess-ment of Thermal Stratification for the Seabrook Unit 1 Pressurizer Surge Line" (WCAP-12151 dated February 1989) and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
The letter also provided an Enclosure 4, an affidavit, dated February 27, 1989, of a Mr. Robert A. Wiesemann, a management official of the Westinghouse Electric Corporation. Mr. Wiesemann stated that the information in the above-mentioned report is of a type customarily held in confidence by Westinghouse and not customarily disclosed to the public. Mr. Wiesemann also stated that the information is held in confidence because it falls in one or more of several types as follows:
(a) The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse con-stitutes a competitive economic advantage over other companies.
(b)
Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
(c)
It reveals aspects of past, present, or future Westinghouse or customer funded development plans and programs of potential commercial value to Westinghouse.
The information submitted in Mr. Thomas' letter and Mr. Wiesemann's affidavit was reviewed against the requirements and criteria of 10 CFR 2.790, and it has been determined that the submitted information sought to be withheld contains proprietary connercial information.
