Gentlemen:
This refers to the inspection conducted by Mr. A. B. Earnest of this office
during the period February 6-10, 1989, of activities authorized by NRC
Operating License DPR-46 for Cooper Nuclear Station, and to the discussion of
our findings with members of your staff at the conclusion of the inspection.
Certain areas within the security program were examined during the inspection.
Within these areas, the inspection consisted of selective examination of
procedures and representative records, interviews with personnel, and
observations by the NRC inspector.
The inspection findings are documented in
the enclosed inspection report.
During this inspection, it was found that certain of your activities appeared
to be in violation of dRC requirements.
The apparent violations, and the basic
issues underlying them, may parallel the findings of NRC's Office of
Investigations (01) Report 4-85-016 which indicated that your staff failed to
report security events that were required to have been reported in accordance
with 10 CFR 73.71. You will be contacted in the future to schedule an
enforcement conference in our office to discuss the apparent viclations
centained in this report and the apparent violations referenced in our letter
of December 15, 1988, by which this office transmitted the summary of 01
Report 4-85-016.
An open item is identified in paragraph 2 of the enclosed inspection report.
The material enclosed herewith contains Safeguards Information as defined by
10 CFR Part 73.21 and its disclosure to unauthorized individuals is prohibited
by Section 147 of the Atomic Energy Act of 1954, as amended.
Therefore, the
material, with the exception of the report cover page which is an inspection
summary, will not be placed in the Public Document Room.
