SUBJECT:
REVISION OF THE ECCS RULE CONTAINED IN APPENDIX K AND SECTION 50.46 of 10 CFR PART 50 This letter transmits the Commission Paper package for the subject rule revision in order to obtain your timely concurrence. The package includes a summary of the public comments on the rule, a notice of final rulemaking, a copy of the regulatory guide which will be published concurrent with the rule, and a sumary of the public comments on the guide.
A draft of this package was circulated to NRR and ARM for coment in December.
Written comments were received and have been incorporated.
When the Comission approved the proposed rule for publication, it directed l
that the staff have the uncertainty methodology being developed by RES subjected to both peer and ACRS review. The ACRS has reviewed the rule package several times over the past two years. They have not indicated any major objections, but have asked to rev!ew the final demonstration of toe uncertainty methodology when it is completed in June 1988. The Peer Review l
Group met in January 1988 and a Sumary Report of its generally favorable i
findings is included in the package.
i Based on the above, we believe it is appropriate to go forward with the rule change at this time and forward this package for your concurrence.

CRGR REVIEW 0F REVISIONS TO ECCS RULE This memorandum transmits a copy of the subject Commission Paper package on which we are currently seeking final Office concurrence. The public comment period expired on July 1, 1987 and thirty-three public comments were received. The staff has considered all of the conments in Enclosure E of the package. Please note that all of the comments have been resolved with no substantive changes to the rule which was proposed. Since the rule is essentially the same as the one previously approved by the CRGR, we are proposing to proceed with no further CRGR review. If you agree with this proposal, please inform me so that I may transmit this package to the ED0 for final action once Office concurrence is received.
