NEGATIVE CONSENT FINAL RULE ON EXTENDING THE IMPLEMENTATION PERIOD FOR CERTAIN PROVISIONS OF l THE PROPERTY INSURANCE RULE l ,

The enclosed final rule package for your signature would extend from -

October 4, 1988 to April 4, 1990 the implementation schedule for the stabilization and decontamination priority and trusteeship prov.isions of the property insurance rule promulgated last year in 10'CFR 50.54(w). These provisions require, in part, that insurance proceeds be paid to an independent ~

trustee to forestall any conflicting claims by the bondholders' trustee. The proposed rule was approved by negative consent by the Commission as indicated in a memorandum from Samuel Chilk to you dated August 26, 1988.. The proposed rule was published in the Federal Register on September 19, 1988. (53 FR 36338)

The NRR contact for this matter is Robert Wood-(x21280). Note that OGC has no legal objection to the extension, and that the CRGR has decided not to review this final rule formally.
