Dear Mr. Chairman:

The NRC has sent the enclosed final rule to the Office of the Federal Register for publication. This rule sets forth conditions for determining reactivit control capacity for boiling water reactor standby liquid control systems (ySLCS) and is necessary to clarify the intent of an existing regulation in 10 CFR Part 50.

A proposed rule on this subject was published in the Federal Register on Monday, October 24, 1988 (53 FR 41607).

Sixty days were allowed for public coment.

One coment was received by the NRC, which agreed with the proposed clarification. The Comission believes that the proposed rule adequately clarifies reactivity control conditions for boiling water reactor SLCS; thus, the final rule adopts the proposed rule without modification.

l This rule is clarifying in nature and does not constitute a significant question of policy, nor does it amend 10 CFR Parts 0, 2, 7, 8, 9 Subpart C concerning matters of policy, or 110. Thus, the Executive Director for Operations will issue the final rule under the delegation of authority from the Comission. The rule will become effective 30 days following its 3

publication in the Federal Register.
