ALLEGED DISCRIMINATION AGAINST AN EMPLOYEE FOR HAVING ENGAGED IN PROTECTED ACTIVITIES (CASE 84-ERA-27, NUNN vs DUKE POWER COMPANY)
This refers to the above referenced Department of Labor (DOL) case concerning alleged discrimination against an employee for having engaged in protected activities. Mr. Howard S. Nunn alleged that he was terminated from his employ-ment at the Catawba Nuclear Station on October 20, 1983, for bringing safety concerns to the Nuclear Regulatory Commission. On May 26,1988, the D0L Administrative Law Judge issued an Order of Dismissal and granted Mr. Nunn's motion to withdraw the complaint. The case was dismissed with prejudice.
On November 29, 1988, Mr. Albert V. Carr, Jr. , Corporate Counsel, provided documents relative to this case. After reviewing the pertinent information, we have concluded that no violation of NRC requirements occurred and, therefore, no enforcement action is warranted.
No response to this letter is required. In accordance with Section 2.790 of the NRC's Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the NRC Public Document Room.
